How often is a motion to suppress used to simply delay a sentence or trial?  In regards to a chronic DUI offender facing 4 yrs.

Depends. Suppress what?  That the stop was without probable cause?  Breath or blood test results?  Search?

Length of any delay will depend on the court’s docket. In some courts, suppression hearing might be the morning of trial. In others, might delay the trial a few months.

Not sure.  The filing just says motion to suppress.  I’m guessing his lawyer is saying something wasn’t done correctly.  But he has had several dui’s and now that he has a 4 yr prison sentence they find something to possibly save him?  He has already been in twice….once for probation violation and then right after that for parole violation….the last dui.
