Pistol with a "non-pistol" buffer tube.. One. Last. Time.
Ok guys-
I just ordered a new lower for a pistol build. I wanted to have a bare lower before the 7" upper got here.
So.. Lower sans any sort of buffer tube is enroute.
Now I'm looking for a buffer tube. I own several AR's and AK's. Some of these have AR style stocks, however, I have no "spare stocks" laying around.
I am pretty sure, it's totally legal per the BATFE to use a "rifle" stock with the detents for a stock on a pistol, as long as no stock is readily available to be attached. Am I interpreting this correctly?
Does the stock on another weapon make the pistol available for "readily attached?"
I see no reason to buy a pistol tube, since this will eventually be an SBR lower.
What says you guys?

Short answer, technically legal but unwise.
Personal answer, if you can't afford $25 to insure the safety of your continued right to own a firearm the perhaps you should consider a different hobby.
The ATFE has said several times, and I have one letter from them myself, saying you can use any buffer tube you want, just don't put a stock on it or have a stock around that ONLY fits that buffer tube. As you figured, if you have an AR carbine with a telescoping stock and a pistol with a CAR tube on it (or even have a spare CAR stock around), you are OK because while you could conceivably take the stock off the carbine and put it on your pistol or use the spare stock on your pistol, that does not cross the line because you have a use for the stock on the rifle. It cannot ONLY be used to assemble an illegal SBR. You cross the line when you have your pistol with CAR tube on it, and you have a spare stock that fits the tube, but no other rifle that the stock could be used on. Then there is only one way to assemble the stock, and that is as an illegal SBR. If you use the CAR tube and your rifle has a CAR stock on it, and even if you have a spare CAR stock for the rifle, you are OK. The paranoid will say you are playing Russian Roulette by having a CAR tube on your pistol if there is a CAR stock anywhere in your home but if you take off the tin hat for a moment you will realize that by the time the ATFE is looking up your ass that closely you have a whole lot more troubles than having a spare stock around that could under the right circumstances be used on the pistol.
That said, those $25 RR CAR length pistol tubes look really good, paint to what ever color you want or leave them black, they fit nicely and work perfectly. For $25 I cannot see any reason not to use them, and in fact just recently changed all three of my pistols over to the RR tube from the ACE pistol stocks I had been using. IMO you should always keep at least one pistol lower around anyway because you will get the bug for another pistol or SBR and having a pistol lower around allows you to play with your upper until the SBR paper work comes through. With the paper work running 5-6 months now and will bloom to a year or more once the CLEO sign off is dropped from the Form 1s, a spare pistol lower will allow you to do all your load work up and breaking in while waiting for approval. Spend the $25, free shipping from RR too.
Feel free to use whatever you want.

This is the ideal setup for reliability and shootability.
You wonder why its such a big deal anyway
its not like you can't just but the buffer up against your shoulder anyway.

Some would argue, as I've seen it here before, that if you build it with the intention of shouldering it, you're in violation.
To those who believe it is about "intentions" I would ask, could I then build an SBR and intend to fire it one handed? ;)
