How do high capacity mag. ban laws apply to person to person sales? I have a person in NY that wants to buy a couple of undated colt 30 RND mags. Please advise.

He sends you money. You mail him the mags.

So, does that mean that it is legal for me to sell them to him? How then, does the law apply?

His job to prove its preban. Not yours.

Ok. But my concern is the CURRENT state ban on any mag. over 10 RND. capacity. As I understand it, the law law doesn't care when they were made.
Just that they are over 10 RND. capacity.

Not 100% sure but I dont think you can get in any trouble for shipping them. Regardless of age or round count.

You can own preban mags over 10 rounds in ny. My lgs is a Leo and he sells colt preban 30 and 40 rounders.

They can't have +10 mags made after 9/13/94. Anything made prior is fair game to buy, sell, trade, etc.

That's because they're new production. The OP is talking about old pre-ban mags.

Any magazine produced before Sept 14th, 1994 is good to go in New York. Even a 100 round Beta mag. If there are no stamps whatsoever on the magazine, either inside or out, they should be good to go. If they are stamped on the inside (like many Okay Industries Colt branded mags are), they'll have either just a Kx Ox stamping (x being month), or Kx Ox + year stamping. Pre 86 did not have a year stamp. If they're stamped on the outside, it's pretty obvious.

Anyhoo, it's on the buyer to make sure they're pre-ban.

well in california any sell, transfer or manufacturing of 30 round mags is illegal..even if its a pre ban mag you have to look at the age on the person buying them, if they were not 18 prior to the ban it would be illegal for them to purchase, but you can sell them if they are dissembled..

You're not a resident of NY so who cares. NY laws are not inforcable in WI and the burden of proof is on the guy buying them, not you.

+1 I sold 10 mags with 300 rounds plus another 2200ish rounds of Wolf ammo when I decided to become a brass whore to a guy in CA and disassembled the mags and shipped it.

For Ban states they have to be prior to the 86 date stamp on the mag itself most are stamped with a manufactor date if they are not stamped then they are GTG as no way to disprove they are not pre-ban.

As others had mentioned as long as you follow the states guidelines on shipping its up to the buyer for proof.
