 Picking up my 22Sparrow tomorrow...one last question

Well...the wait is over. This is my first time ownership of a Class III item, and I'm going to pickup my 22sparrow tomorrow but have one last question...

I have it set up in a trust, and when I go to fill out and sign the 4473 form when I pick it up, should I sign as "John Doe, Grantor & Trustee" just as I did on my form 4? For those of you that have done this last step & put the item in a trust, do you have to fill the 4473 form out like "normal" just as if you were buying a regular firearm (your name, signing as yourself, etc..) OR are you using the name of the trust, signing as the grantor/trustee of the trust, etc. I haven't asked my dealer yet, just thought I would get some input from you all and your experiences. Any and all input is appreciated. Thanks a bunch.

I have always filled out the 4473 as an individual. A background check can not be done on a Trust. ATF want to know took possession of the item in the name of the Trust and if that individual is a prohibited person. Some dealers will make you provide a letter signed by the trustee authorizing you to pick up the item in the name of the trust. This is a gray area. It is required for Corp and LLC and some dealer want one for trusts. Call your dealer and ask so you don't have to make an extra trip.

If you refer to the instructions on the form, (Section A, Question 1), you will see that you fill it out as an individual. You are also supposed to submit a written statement saying that the device will be the property of the corporation or trust and give the address of the entity. A lot of dealers (and buyers) aren't aware of this.

I tried to cut-and-paste the language, but for some reason it wouldn't work on the PDF form at BATFE's website.

A Trust is not a business enity, therefore some dealers and buyers think this does not apply. Like I said, it can be a gray area.

When the buyer of a fireann is a corporation, company. association. partnership,
or other such business eniily, an officer authorized to act on behalf of the business
must complete Section A of the fonn with his or her personal information, sign
Section A. and attach a written stalcment, executed under penahies of perjury,
Slating: (A) the firearm is being acquired for the usc of and will be the property
of that business entity and (B) the name and address of Ihat business entity.
