What's the latest on the 50 upper clarification?
Rumors aside, what is the real deal?
The real deal is that a certain person "claimed" there was an official letter that the uppers were going to be regulated by the government. This turned out to be a load of BULLSHIT as Dave from Spider Firearms was all over it once it hit arfcom. Not even a call to the ATF/DOJ from the Fifty Caliber Inst. warranted ANYTHING from them.
The best that anyone could figure is that this individual and his company are being looked at for their lack of building a safe product. That and who knows how many complaints have been filed against them for these reasons. That is probably how the letter came about and how it was brought up here.
I did not mention this person or the company but you asked and this time I will keep my feelings about him in check even though I don't want to. So... everyone else please refrain from calling him names or bashing the company as we all know who and what it is.

Hate to see this kind of thing come up about their product. Took mine out today and had a bunch of fun with it. I am disappointed that if there is no truth to what the fellow states, that he would have stooped to such a level to cover his rear. Sad.
These are the only facts known to date. The rest is the usual conjecture and bullshit (both from the manufacturer and others).

This email is an attempt to respond to several inquiries the Fifty Caliber Institute (FCI) has received regarding the question, "has ATF classified .50 BMG
upper conversions for AR-15 rifles as firearms?
As far as we can determine there has been no decision by ATF to change the ruling regarding AR-15 upper conversions.
What we have found out is, there is only one manufacturer who has made any claim on this. All the other manufacturers that one fellow claimed are covered. All deny any notice from ATF of any issue of the sort. That maker has (by his own admission) been banned from numerous blogs and boards. This same person has had numerous suits brought against him for fraudulent business practices.
My source of information is currently attending the ATF Importers Conference and has had discussions on this subject today (8-2-11) He states Head of Firearms Technology Branch says one manufacturer got a letter from one field division asking him to send a sample to FTB due to law enforcement complaints. He wouldn't detail the complaints because the gun hasn't been received, let alone examined. He assumes that if it happens, the letter will be all over the net pronto.
Hope this helps. At this time I recommend we all just remain calm and I've asked to be notified if any changes come down the road. FCI will make everyone aware of those changes as we receive them.

I had never bought anything from that company and had no opinion of them one way or another until the owner started flapping his pie hole. His attempt to sow fear into the community of .50 BMG shooters is reprehensible, and I will NEVER spend a dime with them and I'll be warning others to avoid them as well.
Still, I find it puzzling as to why someone would out themselves as a huge liar if they had any chance or intent to remain in business.
For those who missed it, this is Chris' statement on the matter:

I know some of you don't care for us.... that's mutual, as I don't care for you either :-)
Some people have speculated that there was a design issue with our uppers, this is not the case, the uppers are as safe as any firearm of this caliber can possibly be. We also only have knowlege of the one OOB in cali that everyone knows of that resulted in injury. That was found to be Ammo related.
Here is what is actually going on.
I have lurked here for the last 3 or 4 months, as I have not been able to say anything regarding our company until official papers were received. As of Today it's official - ATF has killed the upper industry.
We have been notified by ATF Industry operations that The BOHICA MKIV and the Saftey Harbor Upper in particular (With more more to come as I was told) Have been determined to be GCA firearms by the tech branch. We are still waiting on the actual tech branch finding, but have been issued administrative notice that we are no longer allowed to mfg uppers. We have been in a holding pattern for the last 4 months due to notification of a pending finding. I would ASSUME that this will aslo extend to the Ferret, ALS, Tactilite and the Blackthorne as well ( This is MY speculation)
This carries dire consequences for the entire AR15 community as this is no doubt a start of more controls. I was also told that this will extend to the Belt Fed Razorback and LM7 from Lakeside as well as the Ares Shrike.
Obviously this can also be construed to possibly reach to the entire AR upper world, including caliber conversions.
We are in the process of contacting the NRA-ILA for assistance dealing with this matter.
Please refrain from humping my leg or stabbing me in the back for this post. I will provide more info as it becomes available.
Sincerely,
Chris Rosequist
BOHICA Arms Inc.
He was either ignorant of the reason his upper was called in by the ATF and made a bunch of assumptions, was misinformed or mislead by the ATF as to what was going on, or is a complete, dirty liar.
I have a Bohica MKII upper, and it is ok. Not the best looking firearm I've seen by a long shot, but it does work well enough. Every business has it's issues and problem customers. The way his have been dealt with are questionable.
As I've said before, the truth will come out in time.
It's Chris. I'd bet on liar.
Dave at Spyder Arms (Ferrett50) is bonafide.

To AR-15.com,
Please re-instate Dave from Team Ferrett back into the Forum.
Many individuals here do not add as much reliable information as he has done for the 50 community.
His signature file with link to his company, and products, is/was as many others have done.
For his contributions to the community and this website, this minor infraction should be overlooked.
OldmanFCSA,
- and NO - I do not own or shoot one of his products, but appreciate his knowledge.
Ah crud, I missed that Dave had been banned. Ya, I do own and talk up my Ferret. But my reason for this post is to agree with OldmanFCSA's post. Dave does not post often, but his post are full of good dope (information).
Thanks
Why was Dave banned?

I'd missed this too. That's unfortunate, I've learned a ton from Dave's posts and I never thought he was blatantly advertising.
Nope, didnt get banned. Had to delete some stuff though. Seems Ive angered a few people by grinding on the very "issue" this thread is about. Well, I think thats it, not sure really. It doesnt matter though, Ill continue to lurk and post helpful info when I can.

Glad to see you did not get the ban hammer. Maybe I just mistook what was said by another.

This thread is about advertising without being a sponsor?
I kid, I kid...
...no, but it's true.
While you definitely put your bias firmly into things, the facts and insight that are delivered is some good info.
