 can you have a FFL business out of your home or not?

If you are zoned for it then yes.

I was going to get my FFL but found that where I live isn't zoned for small business out if homes...

Yes and don't take their word for it if they tell you that you cannot. Have them show you in writing.

You need to at least have the intention (appearance) of making a profit selling guns. Obtaining an FFL for the sole purpose of doing gun shows or filling your safe with guns will not fly with BATF.

I just took a run at it myself. In addition to the other posters comments the ATF agent I spoke with stressed a secure location for your inventory - preferably separate from your personal firearms. City zoning killed me. Few hundred yards west and I would have been in the county.

Not necessarily. You may be able to get a variance. You need to call/go down to the zoning office and find out what's involved. Usually involves sending certified letters to your neighbors and going to a zoning meeting to make your case. It's difficult, but not impossible.

So am I, but my city alllows certain home based businesses.
Gun dealer is okay....... hair salon, car repair, day care not okay.

I am zoned residential as well but home-based businesses are allowed with certain strict provisions. Since I am able to meet those requirements and there is a history of other home-based FFLs in the area, our FFL was no problem.

I have already had my interview and now am just waiting on the paper FFL so that I can go down and get my county business license. The county won't issue a business license until I have all necessary permits, etc. and that includes the FFL.

This is how I got my FFL. I went down to the County Building & Codes office and picked up all the paper workfor a "Use Permit" (Zoning Variance). When I went in for the meeting the board was going to turn me down because I live in a sub-division and some of the members are anti-gun. They changed their minds when I explained to them that I lived in the county and that although I lived in a sub-division it's 100% legal for me to pull out my M1919A4 and get rid of all 15,000rds of ammo I have for it in the front yard. So my variance states that I can have a home based FFL but no signage and no discharge of firearms on the property.

Same here, zoned residential but allowed a home based business. So far no problem. City still wants their 1% B&O tax. Received my FFL 3 weeks ago without any hassle from the city.

I checked with my township, county, and sheriff. No regs against a home FFL, so application sent.

You WILL need something in writing that states that you can have a in home buisness when you get interviewed. My guy needed to see it and made a copy of it.

Nope. It's up to ATF to show that you cannot have a home based business. Laws restrict, not allow.
