I want to purchase outside my resident state

I have a house in NY and a house in Florida. I reside in NY for all intensive purposes. I would be interested in purchasing a long gun and possibly a pistol in Florida from a gun shop. I also have both NY and Florida concealed permit. My drivers license is NY. I do have a Florida ID card (I can't have two drivers licenses)
When I purchase in Florida do I fill out the 4473 and list my Florida address and list I am a resident of NY?? Basically for a long gun what do I put down and also for a pistol. I will NOT be bringing the pistol back to NY. I know if I had to bring the pistol to NY I would need to get it added to my NY permit.

I know you can purchase a long gun as OOS resident, but I thought they have to ship it to your home state. And pistols are a no go? I may have this all wrong, that was just my understanding.

Perhaps your Florida FFL could help you out.

ETA: As the others state, you can be a dual resident for this purpose. When I was in CA for school, I just went and got a CA ID Card with my CA residence on it, and that worked fine for buying guns. My car and other items remained registered in my home state. You should be able to get a FL ID without any trouble, and that should work.

If you reside in New York for ALL intents & purposes, than that includes your intent to purchase a firearm & the purpose of exercising the RTKBA. You can't purchase a pistol in Florida, & probably not a long arm either. Either get a Florida DL or cave in to living in an anti-gun yankee state.

You can be a resident of both states, and the ATF says if you are you can purchase in both states while you are there as a resident. You don't have to have a primary for gun purchases.

But you must reside an unspecified amount of time in each state.

[18 U.S.C. 921(b), 922(a) (3), and 922(b)(3), 27 CFR 478.11]

(B12) May a person (who is not an alien) who resides in one State and owns property in another State purchase a handgun in either State? [Back]

If a person maintains a home in 2 States and resides in both States for certain periods of the year, he or she may, during the period of time the person actually resides in a particular State, purchase a handgun in that State. However, simply owning property in another State does not qualify the person to purchase a handgun in that State.

Residency, for purposes of buying guns, is not the same as residency for other purposes. If you have a home in Florida, then you are a resident there whenever you are present in Florida with the intent of making a home there. Your Florida CCW, possibly together with your FL ID (assuming one of these shows your FL address), should be all you need to purchase a gun in FL.

That is what I thought. I have my CCW and an Official State ID (looks just like a FL drivers license). When I fill out the 4473 then I use my Florida address and my Florida ID and then were it asks for my residency I put Florida..correct? I know I could just go to a gun show and purchase from a private party but I want to make sure everything is legal! I would probably just purchase a long gun

Incorrect...Or at least I've never had it happen to me. I live in MD and have purchased long guns in VA,PA,TX and FL.

That's good to know, thanks.

ETA: Is that from FFL? Or private seller?

Only from a dealer. Private sales aren't allowed to directly cross state lines, you must go through an FFL.
