 Need Help: How can I legally de-ban my new SAR 8?

I just purchased a Springfield Armory SAR 8 (H&K91 clone) that came with a thread protector welded on and a thumbhole butt stock. The weaon was made in June of 1994 so Im GTG as far as the NYS assault weapons ban, but how many US made parts would I have to add to add a flash hider and regular stock?

You can't have more than 10 foreign parts in the rifle. Here's a breakdown of the parts so you'd need to find US made partrs for the ones you want to replace. The easiest to replace have always been:

Furniture (3 parts)
Magazines (3 parts)
Hammer, trigger, sear.
Muzzle device

What part of NY are you in? I'm a fellow NY'er and if you're interested I have some US made Thermold HK91 magazines that I no longer need. Let me know if you're interested.

Congrats!

Did you get the stamped steel or aluminum receiver? What are they going for these days?

I was able to get the stampted steel receiver. The tag was marked $1299 but I was able to get her with 3 new steel mags for $999.00. She looks like she wasn't fired much, but I did find some surface rust on the inside of the receiver. Most of it came up with a little oil, the rest will be removed when I can get up the money to have her refinished.

I think you got a good deal. If you were planning to have the rifle refinished I would definitely recommend you think about this.

Add a paddle mag release.
If you're going for a refinish, then the rifle will be complete. Before you know it you'll use the paddle release and forget all about the pushbutton. I have a 94 clone with the paddle and love it.

i thought it you de-ban something it was considered "makeing" a new assualt weapon and therefore would not be GTG? i remember reading this somewhere. it was talking about how you cant sell (we'll use an ar as an example) an ar with a collapsable stock to someone in a ban state even if you convert to ban compliant because it was already built and when you change the configuration you are making a new one or somethign like that.

The only thing that matters in NYS is that the weapon or magazine was made prior to Sept. 14th 1994. According to Springfield Armory my SAR8 was imported in June of 1994 so as far as NYS is concerned she is pre ban and not subject to the NYS ban on so called Assault Weapons. I do however have to add 7 US made parts to keep the Feds happy! So stupid but Ill comply...

AFAIK the import parts count is a requirement on the manufacturer and importer. In order for your rifle to be sold in the US it already had to have all the US made parts it needed to keep the foreign parts count to 10 or less. Your only worry is if you replace the US made compliance thumbhole stock with a foreign made part you would have to find something else to swap out. That's why US made magazines are useful. In this case inserting an HK magazine adds three foreign parts to your build. Using a US made magazine does not. Also, don't expect all the US made parts to be stamped as such. I have an FMP G3, (HK91 clone), and none of the parts are stamped in any way telling me where they came from. I figured out the furniture was US made by comparing it to real HK parts, but my fire control group isn't marked in any way. My rifle is a post ban in both cases. Post 1989 import regs, and post 1994 NYS AWB. It came with a regular stock and pistol grip, go figure.
