You can sell to who ever you want I believe.
Depends upon your terms in the advertisement but not knowing the details, I'd say Buyer 1...you made the offer and he accepted it.

I reply via e-mail and IM to post an I'll take it in the thread.
Buyer 2 posts an I'll take it in the thread.
Buyer 1 then posts an I'll take it in the thread.
I believe I'm obligated according to the EE rules to sell to buyer 2 for posting the I'll take it first.
Am I correct?
Thank you
It depends; did you tell buyer 1 it was definitely his, once he posted in the ad?
Example of a deal;
You––––––- Buyer 1, the item is yours, I accept your offer of "I'll take it", please post your intention in the ad.
Example of not a deal;
You––––––––Buyer 1, please post an I'll take it in the ad to seal the deal. Whoever posts "I'll take it" in the ad first gets it.
You can sell to whom ever you want to, as long as you have NOT entered into an agreement with either one.
The rules don't say that the first "i'll take it" wins. It doesn't say that anywhere.
If the guy messaged you first and you already told him to put an "i'll take it" in the ad then its probably going to be his since you were (based on the wording) accepting the deal.
I sell to people all of the time that don't put an "i'll take it" in my ad. They don't get feedback and I don't get feedback but oh well. I do remind them to post in my ad so I can leave feedback in a timely manner.
