So does this site have an absolute/trump card "I'll take it" rule or not?

For instance, I send an IM inquiring to the information in a for sale post saying if "X" is true then I'll take the items. While I am away from the computer the seller responds, that yes "X" is true but nothing else. An hour after the sellers response to me, someone else posts "I'll take it" in the ad and the seller marks it SPF to them. I send another IM saying, what the heck? I said I'd take it. Seller replies that the SITE RULES say that he however posts "I'll take it" on the ad wins........

Now, I always thought this site never had any strict rules saying an "I'll take it" trumps IM and emails........ Other sites have this rule but I did not think that was the case here.

I do see that now the rules do mention the "I'll take it" in regards to the new feedback system however. So what is the deal?

It is completely up to the seller

That's what I thought. What galled me a little is being told that the site rules say he who posts "I'll take it" wins irregardless. It may work that way other places but I didn't think that's how it worked here. Whoever the seller decides to sell to first gets it, doesn't matter if it was a post, IM, or email.

Normally I'd think the very first person to make contact would be the winner, but I guess that's up to the seller.

The part that I am wondering about though is the exception to rule #18 which says you must post an "I'll take it" for feedback. My understanding is that this is just for feedback, not some sort of binding commitment?

I believe it is making a commitment to post "I'll take it" in the thread, I would argue welching if they backed out. ?

It is worded in a somewhat confusing manner. It is indeed for feedback only and has no bearing on who gets the item.

Good thing... because if someone is selling a desirable item and gets responses from multiple people, they have the option of looking at who the people are and, at a minimum, gaging the credibility of the people by their feedback, post count, time as a member, memebrship level or whatever else they feel qualifies one person over another.

There seem to be way too many sh*tbags on here that get memberships just to troll the EE for deals, jump on them, then comparison shop after the fact, find a better price, and back out or similar sh*tty situations.

However... it does seem kind of one-sided in that you can be the first to say "I'll take it" and the seller can blow you off, but if you say "I'll take it" and then blow the seller off you get locked for welching.

Is that a lack of balance?

I'm sure the site could just take the easy way out and remove themselves completely by simply saying "Buy AND Seller Beware: All transaction failures are on you".
Since there's no easy way to verify a user/buyer until you've already committed to a transaction, aside from the feedback forum and whatever user rating the person has, which doesn't necessarily account for anything, there doesn't seem to be a good answer aside from building an eBay-Guns.

pathfinder74––-it isn't one sided. If you say "i'll take it" you have already looked through all of the ads and chosen a seller you wish to deal with.

THEN the seller has to choose you;)

It's like asking a girl out...she can blow you off but you've already expressed your interest.

How about a sales analogy? You go to Walmart and say "I'll take this" and the cashier takes it out of your hand and gives it to the person behind you in line. Because that's more in line with this topic. Take your analogy to eHarmony. ;)

This isn't Walmart. Again, there are already rules and standards set up. This isn't GD. Sure, you can come in here and put all the twists and turns in to a situation however you want. You can theorize it to death. It still doesn't take away from how the site runs. Want more rules?? Just as in my playtime as in my gubment, more rules means more control. More control means less freedoms.

You've got 22,000 posts and been a member here for 10 years. Yet you've got one positive feedback in the EE. What I find amazing is that you don't have any posts or replies in the EE C&Q or Feedback sections on the goings on here until about the last 24 hours. Then all of a sudden you're here in all threads. Whoever pissed in your Wheaties evidently did a good job on you.

You've got a lot of thoughts and ideas but most of what you're discussing has been hashed out long before I was here.

I generally don't buy through the EE... most of my purchases through the EE were long before any feedback system was in place... when i actually had money to spend.

Not sure why I've taken a renewed interested in the EE forum... just saw some stuff that caught my interest. No Wheaties were really pissed upon.
