Also I wanna know how why this isn't charged as a Improvised Explosive.. It has been before IIRC up near Dulth some guy shot 5Lbs of it and caused quite a stir...

According to Tannerite, it is subject to the same exemptions as black powder because it is used in sporting purposes using a firearm to detonate it. If you used a blasting cap, etc or used it to blow shit up commercially then you would be violating laws.

What sort of damage would it do to their berm? I have no problem with someone using Tannerite on their own property but a range has it's facilities to consider.

Zero damage unless you bury it in the berm. Typically it would be placed in front of a berm and not on it. The concerns are not of property damage but of hypersensitive neighbors.

A one gallon shot of Tannerite makes a hole about the size of the bottom of the milk jug and about 3 inches deep on loosely packed clay/sand/dirt mixture. (North Texas Red Dirt)
If it's on a table or something no damage to the berm would occur at all, to the dirt itself not a whole lot more harm than a large rifle caliber would do to the same dirt. Of course, it's all about how you confine it. Tannerite is mostly noise and smoke until you try to pack it into something. Youtube has lots of examples.
A gallon is one hell of a bang though, enough to set off car alarms at 100 yards.
