Say you obtain a non-factory SBR via form 4. The SBR was made by a now defunct builder back when the engraving issue was still in question and the builder didn’t engrave his info. What do you do to remedy this short of taking off the registry and doing a form 1 in your own name?

Second scenario. Factory SBR. Seller took off registry and pinned muzzle device. You buy it and want to SBR it on a form 1. I assume you would have to engrave your info even though it was once a factory SBR?

Well, technically it was on the builder to have the info engraved, so if anyone is in violation of the law, it's them and not you.

Thant said, on the extremely rare chance the ATF ever gets ahold of the firearm for some reason and finds it's not engraved with the proper maker's info, they may resolve it by engraving it themselves in whatever horrible place and way they deem fit.

For the second one, yes.  You'd need a new Form 1, and since you're the maker on a "new" SBR, you would have to engrave your info.

When was engraving not required for any NFA item made  on a form 1?

Seems like mfg info had to be engraved since day one?

That’s kind of what I was thinking. I suppose one could also engrave the original builder’s info themselves.

IIRC, back in the late 90s there was at least one ATF letter out there stating you only needed the original manufacturer info (IE Colt, HK, etc.) for SBRing an existing title 1 firearm.

Prime examples would be the "pistol brace" registrations and also the shotgun-turned-DD registrations like for the Striker-12, Street Sweeper, and USAS-12.

Yes the manufacturer or maker would've been required to engrave (if applicable).

There is no law requiring a subsequent possessor or transferee to do any engraving. @D_Man is correct about that. There's no "remedy" required because there is no violation.

For your scenario #2, yes you'd have to engrave because now you are the maker.

It's always been required except in limited cases like KitBuilder mentioned.  But there have been people, like the dude on TTAG, that have claimed it isn't unless you're selling.  They conflate making a Title I firearm and ATF's suggestion to engrave if selling with making a Title II firearm. They also quote alleged advice from their local ATF field agent.

What does it say for maker on the Form 4?

Engrave that.
