ETA apparently the shootee was a bad dude but the way it went down, I’m not surprised the shooter caught some heat for it

I agree, but this situation was very different than initially reported - the "victim" intentionally went to his ex's house, was known for making threats, had prior arrest for violent crime, was telling the ex she was going to have an "Amber Alert" on the kids, and other harassing behaviors towards the homeowners.  

I do think homeowner was very lucky to get the charges dropped.

I would never recommend shooting someone actively driving away - that's a real quick path to prison in most cases.

The ability to cause death or serious bodily injury isn't visible.
The opportunity to use it isn't visible.
The intent isn't visible.

Even if one could argue on those three, dude is literally driving away. Which gets rid of immediate jeopardy.

Lethal force is only justifiable to stop an attack. IF...and it's a big if...there was an attack, when dude is literally trying to escape then it's difficult to argue the attack is ongoing requiring lethal force to stop.

The dude taking the video might be the world's biggest shithead and society might be better served if he was removed from the planet. But the shots fired there were not justifiable uses of force.

If someone promises to hurt your children, and then they actually show up to your property where the kids live, I don't think you would view that situation as simple trespassing.

He wasn't in the wrong driveway, that was just the story he made up, the shooter's wife is that guy's ex and there is a documented history prior to the event of stalking, harassing and threatening his ex wife and her family.

He was arrested this year for stalking and threatening too.

I don't doubt it.

That's part of prosecutorial discretion. They can choose to not prosecute a case because they don't believe they can get a conviction given the circumstances. Often when the act is criminal but the victim of the criminal act is a shithead a jury will break out the fuck around, find out defense and there's no point in bringing the prosecution.

That doesn't change the objective reality around the UOF, though.

If a police officer walked into a trailer and found what used to be a pretty little 10 year old girl dismembered by mom and her shithead boyfriend and he blew their brains out right there in the trailer and I was on the jury, I'd probably vote not guilty, too. It's still murder, but it's murdering the worst fucking people on earth so go and sin no more.

Seems well thought out.

If I go out to see why someone is in my driveway, I MAY be armed, but I'm not pulling it without a damn good reason. If the guy won't leave, I'm probably just going to ask the township police to stop on by and have a little talk with the guy.

This is a fucking idiot and should rethink gun ownership, assuming he still can own them after this all shakes out.

Of course, the Karens on Facebook see this and want more gun control. Thanks, asshole.
