Kettling of a small group isn’t really kettling…
Have done it- problems started when the sidewalks and buildings were used as part of the kettle structure, and people tried to claim that they were (legally) on the sidewalk to begin with, therefore they were actually following law/orders, etc etc. (been a while so my memory might not be 100% correct.)
Hard to prove or disprove stuff in protest/riot situations sometimes, and even with video, piecing it all together takes time, people, and money. When they really just want everyone to just go away, so no follow up happens, so the cases get dismissed, then 2 years later you pay someone money in a lawsuit, because that is cheaper than paying to do the required follow up to prosecute the cases (also helps if the DA is actually on board). Riot control isn’t easy work, but it is harder when there is no backing for enforcing the laws, and no follow up to make sure good cases move forward.
