BILL TO PROTECT TRADITIONAL AMMUNITION INTRODUCED IN HOUSE, SENATE



Following continued attacks by anti-hunting groups to ban traditional ammunition (ammunition containing lead-core components) under the Toxic Substance Control Act (TSCA) of 1976, Rep. Paul Broun (R-Ga.) has introduced legislation (H.R. 6284) to clarify the longstanding exemption of ammunition under the act. Sen. Blanche Lincoln (D-Ark) has introduced a similar bill in the U.S. Senate. Read more.

GUN-OWNER VOTE COULD DECIDE RACES



With less than a month to go, many congressional and governor's races are neck and neck. As they have in previous elections, the votes of shooters, hunters and gun owners could make a huge impact at the polls on Nov. 2. Some candidates are publicly seeking support from gun owners, as was the case in Connecticut last week. Republican Tom Foley, who is in a virtual dead heat in the race for governor, issued a letter to sportsmen, promising to "protect the individual's right to legally purchase, own, carry and use firearms." NSSF encourages all gun owners to educate themselves on where their candidates stand on the issues and determine who best will stand up for their rights. Bill Would Allow Importation of Korean Surplus M1 Garands and M1 Carbines





U.S. Rep. Cynthia Lummis (R-Wyo.) is seeking to stop the federal government from interfering with the legal importation of surplus collectible U.S.-made firearms from South Korea, the Billings Gazette reports. Lummis has joined with Rep. Joe Donnelly (D-Ind.) in introducing a bill called the Collectable Firearms Protection Act. NSSF, which called for a congressional hearing to investigate this ban, supports the bill.

U.S. Supreme Court Justice Elena Kagan has decided to step down from participating in nearly half of the 51 cases the court has agreed to review this term because of potential conflicts of interest.

The news that Kagan will bow out of an unexpectedly large number of cases sent attorneys and legal scholars scrambling as the first day of the court's new term began Monday. Observers are trying to determine how major case law could be affected by not having a ninth justice on the bench for as many of the 25 cases that the court has agreed to hear so far this year

If Kagan recuses herself and the eight remaining justices are deadlocked 4-4 on an issue, the ruling by the last appellate court to hear the case before it went to the U.S. Supreme Court automatically stands.

Misinformation feared on Proposition 109







Supporters of a ballot measure that would give people a constitutional right to "hunt, fish and harvest wildlife" have launched a committee to fight what they say is misinformation on Proposition 109.





Two Arizona Game and Fish commissioners, Valley hunters and a representative from the National Rifle Association were among the Prop. 109 supporters gathered at the state Capitol on Monday to announce the launch. Commissioner Jack Husted said he wants voters to understand what's at stake if the measure fails.













There's a current trend nationwide to limit hunters' freedoms," Husted said. "We have initiatives to stop dove hunting, to stop bear hunting. They would take mountain-lion hunting away from us with these emotional initiatives. It pains me."





The measure would give the state Legislature the exclusive authority to make laws regulating hunting, fishing and harvesting of wildlife. The Legislature would decide whether to allow the state's Game and Fish Commission to make rules.





Sandy Bahr, director of the Arizona chapter of the Sierra Club, said Prop. 109 supporters are having a difficult time getting their message across because most Arizonans don't think hunting needs greater protection. The Arizona Sierra Club opposes the measure.





"First, it's really clear that the intent of the proponents of this proposition is to (limit) the right of the people to pass (voter) initiatives relevant to hunting, fishing and wildlife," she said. "Wildlife and wildlife habitat belong to all Arizonans, not to the Legislature and not to a narrow group of people who think their rights are more important."





Husted said hunters need more constitutional protection because "anti-hunting" groups are preying on a uniformed public to impose restrictions on hunters.





"I call it the Disneyfication of hunting. They see 'Lion King' and make emotional decisions. There is no 'Lion King,' " he said.





Husted said the constitutional protection would make it more difficult, but not impossible, to pass laws limiting hunting.





In Arizona, groups need to collect more petition signatures to place changes to the Constitution on the ballot, compared with signatures needed to change state law.





Todd Rathner of the National Rifle Association said the biggest misconception about the measure is that it's a "power grab" by the Legislature.





Rathner said the measure would actually limit the Legislature's ability to make hunting laws.

to my understanding its not necessarily that, but more of an issue involving cases she may have had a tie to while being the US Solicitor General

You are exactly correct, there are some 50 cases planned, but she must recuse from approx 25-30 of them due to prior involvment as Solicitor General, and at the lower court level.

"Joe the Plumber” Lays Into HSUS





A recent blog posting by the now famous "Joe the Plumber” slams the Humane Society of the United States and says that Americans have been "blindsided” by the animal rights group. Wurzelbacher earned the nickname "Joe the Plumber” after being videotaped asking a question of then Senator Obama about tax policy during a 2008 Presidential campaign stop in Ohio.





In his blog, Joe Wurzelbacher outlines how HSUS has been targeting sportsmen, dog owners and traditional farming over the last several years through various legislative and statewide referendums.





Holding back no punches, Wurzelbacher states,





"Their idea of utopia is a United States with NO animal ownership; NO meat to eat; NO pets; NO hunting; NO fishing; NO service animals. If chicken farmers would be forced to own no more than 50 chickens they could no longer afford to stay in business. The same will hold true with hog farmers and cattle ranchers.”





"Having tangled many times with the HSUS while defending sportsmen, its great to see citizens with a following like ‘Joe the Plumber’ speaking out about HSUS’s dangerous agenda,” said Greg R. Lawson, U.S. Sportsmen’s Alliance director of communications.

Rocky Mountain Wolf Update





Series of Bills Coming to Keep Wolves Off Endangered Species List





Numerous bills are being introduced in Washington D.C. attempting to exempt the Northern Rocky Mountain wolves from Endangered Species Act protection and return management of the species to the states.





On September 28, both of Montana’s U.S. Senators, Max Baucus (D) and Jon Tester (D), introduced legislation that would remove wolves located in Montana and Idaho from the ESA List and would place control over the management of those wolf populations back to Montana and Idaho.





Essentially, the legislation would return management in the region back to where it had been prior to an August 5 ruling by Judge Donald W. Molloy of the Federal District Court for Montana. That decision placed all of the wolves in the Northern Rocky Mountains, a region including all of Idaho, Montana and Wyoming, back on the ESA List.





Earlier this month, the two Idaho Senators, Mike Crapo (R) and Jim Risch (R), introduced a similar bill while Montana’s U.S. Representative, Denny Rehberg (R) has released a draft of comparable legislation.





Meanwhile, both Idaho and Montana along with Interior Secretary Ken Salazar appealed the Molloy decision.





The Fish and Wildlife Service (FWS) removed protections for wolves in Idaho and Montana because the population in the region has biologically recovered. The agency did not remove federal protection for wolves in Wyoming due to what it considered inadequate state plans to protect its population.





The "carve out” of Wyoming became the focal point of a lawsuit filed by a group of 13 plaintiffs, including several prominent anti-hunting organizations, against the FWS. They argued that under the Endangered Species Act either all wolves in a region can be removed from the Endangered Species List or none can be. Judge Molloy sided with the anti-hunting organizations.

Four States Have Pro-Hunting and Fishing Constitutional Amendments on the Ballot in November





Sportsmen in several states will have the opportunity this November to vote on constitutional amendments to protect their right to hunt, trap, and fish, from attacks by animal rights activists.





Four states will have these amendments on the ballot on November 2: Arizona, Arkansas, South Carolina and Tennessee.





Each amendment is designed to provide state constitutional protection for the right to hunt and fish. They have been drafted to head off possible attacks by animal rights/anti-hunting groups that could parachute in to various states at any time with campaign aimed at curtailing traditional sportsmen’s activities.

The USFWS is offering a reward of up to $10,000; the AGFD Operation Game Thief is offering a reward of up to $1,000; and the NMDGF is offering a reward of up to $1,000 for information leading to the conviction of the individual(s) responsible for the shooting deaths of Mexican wolves. A variety of non-governmental organizations and private individuals have pledged an additional $46,000 for a total reward amount of up to $58,000, depending on the information provided.





Individuals with information they believe may be helpful are urged to call one of the following agencies: USFWS special agents in Mesa, Arizona, at (480) 967-7900, in Alpine, Arizona, at (928) 339-4232, or in Albuquerque, New Mexico, at (505) 346-7828; the WMAT at (928) 338-1023 or (928) 338-4385; AGFD Operation Game Thief at (800) 352-0700; or NMDGF Operation Game Thief at (800) 432-4263. Killing a Mexican wolf is a violation of the Federal Endangered Species Act and can result in criminal penalties of up to $50,000, and/or not more than one year in jail, and/or a civil penalty of up to $25,000.

Nullifying Unconstitutional Federal Acts





The November elections are roughly a month away, and they couldn’t come soon enough.





More Americans are seeing every day how out-of-control federal officials have become. As Angelo Codevilla aptly put it, they have become The Ruling Class, and a very corrupt one at that.





Patriotic Americans are hoping that the November 2 elections will bring this growing soft tyranny to a halt, but it remains to be seen if congressional Republicans will have the gumption to reverse what they themselves contributed to when they controlled the federal government. If the Senate in 2011 includes Senators Sharron Angle (NV), Marco Rubio (FL), Joe Miller (AK), Ken Buck (CO), Christine O’Donnell (DE), Mike Lee (UT), and a few others, then the GOP caucus may well be forced to cut programs and agencies rather than continuing to bloat them.





But the states, happily, have not been waiting for the federal cavalry to come over the hill. States have rediscovered their powers of nullification rooted in the Tenth Amendment. That wonderful amendment reads that, "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”





Historically, the most widespread use of nullification was in the North in the years shortly before the War Between the States. They passed laws nullifying the Fugitive Slave Law in spite of a Supreme Court decision upholding it. That point needs to be stressed. The Supreme Court is not the last word in determining what is constitutional. The voters of each state are. If they re-elect politicians who will nullify Supreme Court opinions and unconstitutional laws or regulations, then so be it.





The states have now nullified the REAL ID Act, which would have converted state driver’s licenses into a national ID card filled (electronically) with all kinds of personal information. Years past the deadline, that unconstitutional act has never been implemented. In addition, many states are nullifying Obama’s efforts to socialize American medicine (or have already done so).





And of particular interest to gun owners, eight states have recently enacted a Firearms Freedom Act. These Acts provide for a nullification of all federal gun laws in cases involving guns made in a state, and which remain in the state. Wyoming’s law has one extra provision that is almost perfect.





The Wyoming statute provides for a penalty of up to 365 days in jail for a federal official who attempts to impose a federal gun law in contravention of the state’s Freedom Act. Perfection would require amending the law to provide for up to 366 days in jail. That extra day – even if the sentence were suspended following conviction – would trigger the federal law which would revoke the offending agents’ civil rights, including their right to keep and bear arms. I personally do not think that revoking a person’s Second Amendment freedoms for non-violent crimes is constitutional, but for the time being this penalty provides a handy tool for removing the federal boot from our necks.





A 366-day provision inspired by the Wyoming law not only needs to be inserted into all states’ Firearms Freedom Acts, it needs to be part of any state law nullifying all unconstitutional federal laws and regulations. Firearms Industry Matches ATF Reward in Bedford Heights Firearms Theft





NEWTOWN, Conn. — The National Shooting Sports Foundation (NSSF) –– the trade association for the firearms industry ––announced a $2,500 reward for information leading to the arrest and conviction of the persons(s) responsible for the theft of firearms from Atlantic Gun and Tackle, 5425 Northfield Road, Bedford Heights, Ohio. This reward offer matches a $2,500 reward offer by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).





The burglary occurred between the late evening hours of Wednesday, Aug. 18, and the early morning hours of Thursday, Aug.19, 2010.





Steve Sanetti, president of the NSSF, said, "Our matching reward offer will hopefully help assist ATF and local law enforcement in solving this crime against a federally licensed firearms dealer and lead to the swift recovery of stolen firearms before they can enter the illegal underground black market where they can be misused to commit violent crimes."





The matching reward payment by NSSF will be granted only following payment of the initial ATF reward.

2010 Western CMP Games and Creedmoor Cup set for Oct. 16-26





Oil up your vintage M-1 Garand or carbine, it’s time to think about high-power rifle shooting "Western Style” at the 2010 Western CMP Games and Creedmoor Cup Matches at the Ben Avery Shooting Facility in Phoenix on Oct. 16-24.





This competition entails using vintage military rifles. For instance, there are matches for Springfield Rifle, M-1 Garand, M-1 Carbine, a vintage sniper test match, and a vintage military rifle match.





All interested shooters, including new shooters, experienced competitors, recreation-oriented shooters and national championship contenders, are invited to participate in these unique, national-level competitions.









All competition, clinics and special activities take place at the Ben Avery Activity Center, High Power Range or Small Bore Range.

Most Congressmen in monthly survey fail on Second Amendment





"I HAVE GIVEN the significance of the Second Amendment much thought, and will continue to do so,"  Rep. James Roosevelt of California's 26th Congressional District wrote in response to a question asking for his on-the-record opinion on the right to keep and bear arms.  "Frankly, however, I do not feel, as yet, sufficiently clear in my own mind as to what the position should be. I could not, therefore, make a public statement. Your views will be very helpful to me as I consider the matter."



Just how much effort Rep. Roosevelt could have actually put into those ponderings might be a fair question, but it's a moot one. This response was given 50 years ago and published in the "Know Your Lawmakers" feature in GUNS Magazine.

Should you have a legal duty to retreat from an intruder or attacker?



Pennsylvania's "Castle Doctrine" bill, H.B. 40, has cleared an important hurdle. From The Bulletin:







The state House of Representatives voted last Tuesday for a bill to expand the legal use of deadly force in self-defense of individuals and their property...





What, someone presumes to tell them they're not allowed to do that now? And here's another outrage:







Current law also requires an individual to retreat from the threat before using deadly force if the individual is in a public place.





Really? These people realize such encounters can be over in mere seconds? Or is it they just don't care?





The anti-defense crowd is crying foul. From Brad Bumstead at the Tribune-Review:







Gun-control advocates were furious, claiming that supporters of the Castle Doctrine extension had unfairly cut off debate on the bill, which would expand Pennsylvania's law on self-defense.

Will posting comments here put YOU on the government's watch list?





Several developments have occurred in recent days that indicate something as innocuous as visiting pro-gun rights websites that are critical of government Constitutional compliance, and especially participating in comments and forums, can results in heightened law enforcement scrutiny and even as a supporting criteria for "legal" intervention.





On Friday, I told WarOnGuns readers I was aware of a child welfare case in New Hampshire where one of the criterion for removing a child from its parents was an ostensible membership of the father in what protective services was characterizing as "a militia known as the Oath Keepers."





Long-time readers know we've discussed Oath Keepers––specifically not a militia group––many times, including attempts by the Department of Homeland Security, the Southern Poverty Law Center, opportunistic politicians, and certain media outlets to conflate them with violent haters. For this, and other reasons, I told WoG readers I was deferring to Rhodes to take the lead on this, and maintaining contact with him behind the scenes.





He has since issued this report, used as the basis for a WorldNetDaily story by Bob Unruh. It appears the father in question's tie to OathKeepers was that he commented on their forums. A danger, per Rhodes:

ATF: Surplus Korean firearms imports 'pose a threat to public safety in the U.S.





In August, I asked "Why is Obama Administration blocking import of surplus rifles?," citing "problems" that were described as "ambiguous" being the reason a sale previously approved by the State Department had been halted.





The ambiguity has now been cleared up. A Bureau of Alcohol, Tobacco, Firearms and Explosives advisory titled "Effect of Granting Retransfer Authority" shows us the rationale behind the move. NSSF Supports Boy Scouts with $100,000 Grant



NEWTOWN, Conn. — The National Shooting Sports Foundation will award for the fourth consecutive year a $100,000 grant to Boy Scouts of America in support of sport shooting opportunities at councils nationwide.





The funding allows the BSA Shooting Sports Grant program to provide assistance to Scout councils that have shooting programs or want to develop one. Learning about firearm safety and marksmanship has been part of Scouting for decades, and increasingly it's an activity that no longer ends when summer camp is over. Many local Scout groups now offer year-round target shooting programs thanks in part to funding from the BSA Shooting Sports Grant initiative.





"This is a tremendous initiative that reaches the grassroots level of Scouting and that will make a positive impact on more than 100 councils by the end of this year," said Frank Reigelman, BSA's director of outdoor programs. "The ongoing support of NSSF has helped keep the future of the shooting sports bright in the Boy Scouts of America."

Ammo-Makers Expand Production and Hire Workers in Idaho



Two ammunition manufacturers in Lewiston, Idaho, plan to add "significant numbers of workers” this year and next. Alliant Techsystems (ATK), parent of CCI, Alliant Powder, RCBS and other companies, expects to add about 100 jobs by the end of 2010, and Extreme Bullet plans to expand its facility and add about 100 jobs over the next few years. ATK’s employee ranks will grow to approximately 1,200 workers by the end of this year.

ATK will be re-hiring many workers laid off in a 2009 force reduction. According to the Spokane Journal of Business, "The new hires should give ATK a total of about 1,200 workers by the end of 2010 at its plant on the east side of the Snake River.” The Journal also interviewed ATK Spokesman Jason Nash who explained: "We’ve definitely had a few good years at the plant there. There’s been an increased demand for sporting ammunition, which has allowed us to add to our employment base.”

Potterfields Donate $1 Million to National Wild Turkey Federation





Larry and Brenda Potterfield of MidwayUSA recently donated $1,000,000.00 to the National Wild Turkey Federation to support youth shooting programs, including the JAKES Take Aim program. The JAKES Take Aim program provides youths (ages 17 and under) with opportunities to try shooting in a safe, fun environment. With the big donation from the Potterfields, over the next four years, the NWTF aims to triple the annual number of youth shooting participants at JAKES events –- from 50,000 to 150,000.

Shouldn’t Illegal Immigration Take a Back Seat to Guns

Crime Control vs. The Bill of Rights

Arizona ––(Ammoland.com)- The entire world, driven by news reports, has fixated on the enormous illegal-immigrant invasion Arizona has suffered under for years.





The invasion had previously been ignored, a news-media black hole from which little information escaped.





The catalyst for the attention is my bill SB1070, empowering our law-enforcement agencies to deal with the invasion. We passed it because the federal government is aiding and abetting the invaders, instead of stopping them and defending the nation against a flood of biblical proportions.





But SB1070 is a simple criminal statute, enacted to treat symptoms of a harmful crime — sneaking into our nation to commit felonies, leach off our successes, eat out our substance. A different law, SB1108, for which I am equally responsible, is the more important act.





SB1108 is no simple crime-control law. It repeals outrageous infringements to the Bill of Rights, reinstating wholesome fullness to the right to keep and bear arms. The media however, driven by a nearly fanatical racist miasma, blindly focused on the immigration-crime law — finding racism where none exists – at the expense of even noting the strengthened Bill of Rights, despite a packed news conference for SB1108.

Not all 'crime guns' have been used in crimes





One of the expressed concerns raised by the Bureau of Alcohol, Tobaccco, Firearms and Explosives over the Korean surplus rifle dispute discussed in yesterday's column is to not add another source for "crime guns." Unsurprisingly, this is also one of the main arguments used to introduce restrictive new U.S. laws as a purported means of disarming Mexican narco-terrorists, as well as a centerpiece for New York City Mayor Michael R. Bloomberg's anti-your guns crusade.





It's used because it's a powerful term. "Crime gun" evokes a hardboiled detective recovering one from a crime scene, no doubt picking it up with a pencil through the trigger guard, or a white-coated CSI technician lining up recovered bullet striations under a microscope, all leading to the inevitable outing of the villain.





It was Col. Mustard with the .45 in the library.





This isn't to discount the validity of these investigative techniques––they are used and can be crucial to establishing justice for victims and extracting dangerous characters from peaceable society.

IANSA & UN Would Ban Surplus Ammunition Sales



The other equation with surplus ammo is that it has red tape that can "gum up the works” because this involves international and global markets. Thus the normal "supply and demand” equation is still true, but government regulations can actually create a problem with supply, which only further increases the demand. The Soviet era ammo that was once impossible to find, and then became plentiful could again dry up as some anti-gun / anti-freedom groups look to block its entry into the United States.



"Ironically, the BATF along with the Hillary Clinton State Department, is trying to end the importation of ammuntion and arms,” says Summerhill, noting that while the government can claim to have made no attempts to regulate firearms, a backdoor gun ban is possible if the government tightens control on surplus ammo. "They’re trying to block the importation of ammo. There are no laws to stop the importation, but they’re trying to increase regulation, which would still block the ammo from coming in. That’s what we’re seeing now. It is going to be interesting to see what surplus ammo is allowed in the country.”

Oh . . . now we understand. New polling results show Democrat leader of the U.S. Senate Harry Reid is at least 3 points down to challenger Sharron Angle.



And when you're the Majority Leader of the U.S. Senate, it's very hard to handle the fact you may LOSE your Senate seat on November 2nd. But that's where Harry Reid finds himself.



How can this happen? It may be that Reid's constituents have finally realized that every time his mouth is moving, he's telling tall tales. Like when he says he's pro-gun, after casting anti-gun votes more than 42 times in the Senate. And his latest votes may be his worst. You can't vote to confirm Sonia Sotomayor and Elena Kagan to the United States Supreme Court and say you're pro-gun. You can't vote to confirm radical anti-gun Eric holder as U.S. Attorney General and say you're pro-gun.



Fact is–– you can't claim to be pro-gun if you're Harry Reid, and Nevada voters are finding that out. Pro-gun, GOA endorsed candidate Sharron Angle will need to keep the pressure up on "Dingy Harry" from now right up to Election Day.

Gun owners must consider more than NRA grades





Those who follow gun blogs know there's a recurring debate between gun owners who prefer National Rifle Association political strategies and those who challenge them. I'd like to address a few of the more contentious points I see being raised on blogs and discussion boards:





Gun Owners of America grades candidates on issues that have nothing to do with the Second Amendment, for instance, they counted a vote against Candidate X because he/she voted for what they call "anti-gun Obamacare." That has nothing to do with guns.







Harry Reid didn't think so when he offered an amendment to the health care bill––one, incidentally, that would do nothing to protect gun owners caught afoul of any of the innumerable patchwork anti-gun edicts that exist throughout the land. And despite the claim that with this "victory" we have nothing else gun-related to worry about from the health care takeover, if one willfully defies it to get standing to challenge its Constitutionality (or even does not but is adjudicated willfully noncompliant anyway), a whole new opportunity to be convicted on felony charges and to become a "prohibited person"––barred from owning guns forever––has just been created.

Suit Filed on Behalf of Veteran Denied Gun Rights



Acting on behalf of a Georgia resident and honorably discharged Vietnam War veteran, the Second Amendment Foundation(SAF) has filed a lawsuit against Attorney General Eric Holder and the Federal Bureau of Investigation over enforcement of a federal statute that can deny gun rights to someone with a misdemeanor conviction on his record.

The lawsuit was filed in United States District Court for the District of Columbia. SAF and co-plaintiff Jefferson Wayne Schrader of Cleveland, GA are represented by attorney Alan Gura, who successfully argued both the Heller and McDonald cases before the U.S. Supreme Court.



In July 1968, Schrader, then 21, was found guilty of misdemeanor assault and battery relating to a fight involving a man who had previously assaulted him in Annapolis, MD. The altercation was observed by a police officer, who arrested Schrader, then an enlisted man in the Navy, stationed in Annapolis. The man he fought with was in a street gang that had attacked him for entering their "territory,” according to the complaint.

CMP Seeks Volunteers for Gun Gauging and Grading Program



Inspecting and grading thousands of surplus rifles is a huge task. Accordingly, the Civilian Marksmanship program seeks volunteer manpower to help with this process. In an effort to give the Garand shooting and collecting communities an opportunity to view and participate in CMP Inspection and Repair processes and to reduce labor costs, the CMP established a volunteer program starting in July, 2010. Most volunteers work for 3-5 days.



The CMP is looking for more volunteers. Assignments are based primarily on individual level of familiarity with the Garand, and the CMP’s needs at the time. Although the CMP tries to ensure that volunteers spend time working with Garands, some time may be spent in warehousing, packing, or shipping operations. Volunteers must be pre-approved, with work sessions scheduled in advance. No walk-ons. Volunteers should submit requests at least two weeks prior to planned visits (many volunteers schedule "shifts” months in advance).

We write today out of serious concern regarding recent reports indicating the State Department—in conjunction with the Department of Justice and the Bureau of Alcohol, Tobacco, Firearms, and Explosives—has arbitrarily chosen to ban the sale of surplus M1 Garand and M1 Carbine rifles from South Korea to qualified buyers in the United States. We strongly urge you to reverse this decision.





According to recent reports, although the Obama Administration had approved the sale of these vintage, American-made rifles last year, your Department chose to reverse the decision because the firearms "could potentially be exploited by individuals seeking firearms for illicit purposes." A spokesman for your Department went on to say, "We are working closely with our Korean allies and the U.S. Army in exploring alternative options to dispose of these firearms." This decision amounts to no more than a backdoor gun ban that lacks any basis or justification under current Federal law and policy. This decision violates law-abiding citizens' constitutional right, protected under the Second Amendment, to purchase these firearms for legitimate purposes such as target shooting, hunting, collecting, and self-protection.





As you may know, the M1 is the rifle that helped our American troops claim victory in World War II. In Korea and Vietnam, our troops went into battle armed with this rifle that in the words of General George S. Patton, "is the greatest battle implement ever devised." Today, the M1 is lawfully used by American citizens for recreational activities and is also a highly collectible firearm for those interested in American history.





Furthermore, according to the Bureau of Alcohol, Tobacco, Firearms, and Explosives Guidebook on Firearms Importation, it is legal to import M1s because they are more than 50 years old and therefore qualify as "curios or relics." Moreover, any individual wishing to purchase one of these firearms would be subject to the National Instant Check System. Essentially, the sale of these historic rifles—each a piece of America's proud history—pose no greater risk than the sale of any other firearm legally sold in the United States.





To this end, we request an explanation of your reasons for blocking the importation and sale of American-made rifles from South Korea, and we strongly urge you to reverse your decision in the interest of protecting Americans' Second Amendment rights. Furthermore, we encourage you to consider utilizing the Civilian Marksmanship Program (CMP) as a means for the sale of these rifles. Currently, the principal rifles sold today through the CMP—a federally chartered non-profit organization dedicated to training and educating U.S. citizens in the responsible use of firearms—are World War II-era M1 Garand rifles.

CNBC Attacks Remington in Upcoming Broadcast



On October 20th, CNBC plans to air a television "exposé” about Remington Arms. The hour-long show argues that there may be a safety issue associated with the Remington 700 series of rifles. We haven’t viewed the show yet, but Jim Shepherd of The Shooting Wire is familiar with its contents. Jim, a veteran journalist, recently wrote a cogent commentary on CNBC’s "investigation” of Remington. Given the important insights Jim reveals, his commentary is well worth reading.







Yesterday morning, I received a promotional piece from CNBC, touting an hour-long investigation into America’s largest firearms company. The promo piece teases "Remington Under Fire: A CNBC Investigation” a story that CNBC says will "take viewers inside a 10-month investigation of the world’s most popular hunting rifle and examines whether a company has gone too far in protecting their signature product.” That product being the Model 700 bolt-action rifle. With more than five million sold, it is hard to argue its domination of the bolt-action rifle market.

Citibank Continues to Deny Credit to Firearms Industry





Once again Citibank has drawn the ire of the firearms community over its credit policies. This time it deals with not extending lines of credit to businesses even remotely related to the firearms industry. As many people remember back in January 2008, NSSF took Citi Merchant Services to task over its decision to stop processing credit card transactions involving the lawful sale of firearms by law-abiding, federally licensed, firearm distributors/retailers. Unfortunately, it became evident that the decision was not a mistake of a single employee, but was rather a corporate-wide policy.





Fast forward to October 2010 when the Warne Scope Mounts Company of Oregon, manufacturers of scopes and components, decided to submit an application for a business line of credit to purchase materials from the Home Depot. The credit line was initially approved, only to be rescinded the next day by Home Depot Credit Services, Citibank (South Dakota), N.A., Creditor based upon the simple explanation that, "It’s because of the industry you are in.” The term industry simply meant that the company "makes parts for the gun industry.” A law-abiding manufacturer that wanted to purchase materials from the Home Depot NOT to be used in the making of their products was denied credit simply because of the association with the firearms industry.

HUMANE SOCIETY WRITES $250,000 CHECK TO DEFEAT 'RIGHT TO HUNT'



It was reported last week that the Humane Society of the United States wrote a check for $250,000 in its continued push to defeat Proposition 109 in Arizona, which would protect the right to hunt and fish in the state. This extremist anti-hunting group, which has vowed to end hunting "state by state," will stop at nothing to take away the right to hunt and fish. Fortunately, support for Prop 109 is slightly ahead, according to a poll published last week, by a tally of 42 percent to 35 percent. This is entirely too close, and NSSF urges all sportsmen in Arizona to cast a "yes" vote on Proposition 109.

New York gubernatorial candidate Andrew Cuomo (D) is continuing his assault on the Second Amendment long after his threatened litigation of the firearms industry by now supporting microstamping. Ted Nugent fires up tea party supporters





Before appearing on stage Saturday night, rocker and activist Ted Nugent went pheasant hunting. But once he grabbed the microphone, it was red meat that Nugent threw out to an appreciative audience.





"The evidence is overwhelming if you’re not asleep,” Nugent told the small crowd at the rally sponsored by Citizens For Liberty, a tea party group. "If we don’t make a dramatic change this November, we’re done. They will rape and pillage your paychecks to reward monsters.”





Nugent castigated Democrats in Washington and around the nation, describing them as tyrants and power abusers. He told the audience of about 250 people that it wasn’t enough for them to vote out "leftists.”





"You’ve got to fix everybody you know that is not engaged,” Nugent said. "Does anybody know anyone here who voted for Barack Obama? Well, you’ve got to fix them.”...



The freedom Nugent and others expressed Saturday was the right to bear arms, which Nugent said was fundamental to being an active citizen. Nugent said he cares so much about that right that he does not allow anyone to be in his band, hunt with him or even drive his bus without first being a member of the National Rifle Association.





"I’ve fixed everybody in my world,” he said. "Have you?”

Mayors Against Illegal Guns Twists The Truth About Firearms Trace Data





NEWTOWN, Conn ––(Ammoland.com)- In a recent report by the Mayors Against Illegal Guns (MAIG) coalition, an anti-gun organization led by New York City Mayor Michael Bloomberg, the group misuses firearms tracing data in order to push its own gun-control agenda.







Let’s set the record straight:





The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) has repeatedly stated, "The appearance of [a licensed dealer] or a first unlicensed purchaser of record in association with a crime gun or in association with multiple crime guns in no way suggests that either the federal firearms licensed dealer (FFL) or the first purchaser has committed criminal acts. Rather, such information may provide a starting point for further and more detailed investigation.” (Crime Gun Trace Analysis Reports, ATF, 1998).





According to ATF, the average time to recovery in the U.S. is more than 10 years. In other words, from the time a firearm is first purchased at retail (following a background check) to the time it is recovered by law enforcement, more than a decade has elapsed. If one were to isolate the top 10 source states, the time to recovery stays a similarly high 9.9 years. These numbers, state ATF, are not indicative of firearms trafficking. Furthermore, every state, every one, is its own top source state for recovered firearms.

CNBC Attacks Remington in Upcoming Broadcast





On October 20th, CNBC plans to air a television "exposé” about Remington Arms. The hour-long show argues that there may be a safety issue associated with the Remington 700 series of rifles. We haven’t viewed the show yet, but Jim Shepherd of The Shooting Wire is familiar with its contents. Jim, a veteran journalist, recently wrote a cogent commentary on CNBC’s "investigation” of Remington. Given the important insights Jim reveals, his commentary is well worth reading.







Yesterday morning, I received a promotional piece from CNBC, touting an hour-long investigation into America’s largest firearms company. The promo piece teases "Remington Under Fire: A CNBC Investigation” a story that CNBC says will "take viewers inside a 10-month investigation of the world’s most popular hunting rifle and examines whether a company has gone too far in protecting their signature product.” That product being the Model 700 bolt-action rifle. With more than five million sold, it is hard to argue its domination of the bolt-action rifle market.
