Another response would be to refer every school call to the prosecutor, either for a legitimately prosecutable offense or school officials for making a false call for service. In Loco Parentis applies to the school officials.

What’s more, Carey also said that "just about every incident” should be reported to the New Jersey Division of Child Protection and Permanency. According to Philly.com, Superintendent Scott Oswald estimated that the cops may have been called to as many as five incidents per day in the district of 1,875 students over the last month.

1st amendment rights apply to that 3rd grader.  If the school does not like what he said, it's a civil matter between the principle and the parents.  I'd send the bill to whoever at the school called the police.

Police still need probable cause to make an arrest or referral to the prosecutor. I don't know of any state where a 3rd grader is considered responsible enough to commit a crime. School officials are also legally responsible for the children entrusted to their care and legally allowed to act as parents during the time kids are entrusted to them.

No one was either arrested or referred for prosecution.  

Another article:  Directive came from prosecutor, threatened school officials with charges for not reporting.

Policy dropped.
