I guess it's just one of those things. People on that moral high horse don't think about their actions clearly.
I remember an incident of my own a long time ago when I was just a boy. Probably only 6-8. Still remember it. It's quiet time in the daycare center. I'm walking around. Then I hear someone singing loudly. Its a girl. I follow the noise knowing that I have to enforce the rules. It's time to be quiet doesn't she know that. I come around the corner and yell at her. "hey be quiet!" Then I see her and she sees me. Her skirt hiked up. Her panties around her ankles. She's sitting on the toilet... in the girls bathroom. She screams for one of the daycare workers.  No trans insanity to save me in those days.

Well, thank you for your insights and for providing the statute. I have to say at the outset, you’re going to find typographical errors in my posts Because I rely on voice to text. You can generally determine resulting typographical errors from context. The charge of sexual battery is certainly better supported by the language of the statute, which doesn’t focus on the touching occurring for sexual purposes. But I still don’t believe the charge is appropriate. The offense is still a specific intent crime. Objectively, what do we know about the women’s intentions? She intended to touch the woman’s skirt, not her butt. You can speculate that she intended to touch her butt, but I think everyone agrees that she was tugging her skirt down. You cannot argue that she “knew or should have known” that by touching the girls skirt, she would come into contact with her butt. That’s because “knew or should have known” is excluded from the intent element by virtue of it’s inclusion under the “affront or alarm” element. Expressio unius est exclusio alterius. So what evidence is there that she intended to touch her butt? Intending to touch her skirt is not the same as intending to touch her butt, THROUGH her skirt. And you can’t say she knew or should have known that she would come into contact with the girl’s butt, because the statute forecloses that argument. |

You have tons of illegals driving that aren't licensed anyways. Tickets mess with your insurance. Probably have a 20% increase on the first and another 20% on the second ticket. That should be your biggest concern It has been a VERY long time since I have seen a license invalid due to points for driving. It is suspended for unpaid tickets, insurance or revoked for a DUI. |
