The bad guys lawyers filed a R.41 dismissal.   In Ohio that means they have 1 year to start it all over again, but as of today it's over.

This entire thing was a bullshit bluff all along.  We called them on it and didn't offer a penny in settlement.  They knew they would never win at trial so they quit.  

They can refile, but  their lawyers know its a lost cause and, and I can't imagine any other lawyers will want to pick this up and expect a different outcome.

Thanks for all the support, it's been a wild ride, and fortunately the bad guys lost.

They have yet to produce a single piece of evidence to contradict my statement to Detective Albright that there were no indications they were attempting to make a straw purchase.

He is an expert on suicide. He said reading the depositions wouldn't make any difference in his conclusion that Allison would still be alive if Jerry didn't give her a gun.  That's it.  His testimony at trial is going to be a complete non issue.

Zohn? No.  He dropped her off in the morning after a night of what I would guess of sloppy hotel sex.  The coroner put her time of death as 3:22PM.

There isn't an acquittal in civil court.  The jury will either find I was negligent or not.   There is nothing wrong with the judge, she's just a cog in a broken system.

No, she denied our motion to dismiss a couple months ago.  According to her, the plaintiff making a motion to close the estate is somehow a mistake of the court and the nunc pro tunc was proper

Broken cog today, proper tool tomorrow.   If by chance Hell freezes over and a jury sides with the bad guys - that improper nunc pro tunc order will be ruled as reversible error on appeal.

I was referring to the deposition by the firearms expert.

His deposition is the 19th.  Reading his report, I’m 99% sure he never saw my deposition, and more than likely he only saw the parts of Zohn’s that they wanted him to see.

The Judge will suffer slight embarrassment from being overturned, that's about it.  I'm spending thousands of dollars that I shouldn't have to but as George Carlin said, It's a big club, and I'm not in it.

No, I wouldn't say that about the expert.  He read what he was provided.  When it comes to lawyers, it's a game of lying through omission. He was  provided a copy of the complaint though.  Think of that. He wasn't given a copy of swarn testimony of the 2 people who were there - - but he read a fictional version of the events written by someone who wasn't there, who never spoke to anyone who was there.  Disgusting, but that's what lawyers do.  No matter, he had nothing to say that is going to hurt me at trial.

The "gun expert" has his deposition at 9AM.  I can't wait because I know it's going to be another nail in the coffin of their immoral cash grab lawsuit.

In the mean time, I received the deposition of their other expert yesterday.  I'll just leave this little tidbit which sums up the absurdity of it all.  

Man, just when I though nothing could surprise me...

The gun expert said he read my deposition and Zohn's deposition and that Zohn is telling the truth.    He didn't give an expert opinion based on anything other than the deposition of a convicted felon.  All he did was pass judgment against me.
