ASHEVILLE, N.C. - Police say an Ohio man has been charged after authorities spotted him with a gun in a North Carolina airport parking lot as Air Force One was departing.

Asheville Regional Airport police Capt. Kevan Smith says at about 2 p.m. Sunday, officers saw 23-year-old Joseph McVey get out of a car in the public lot and he had a handgun.

Security was heightened because President Barack Obama was departing after vacationing in the state. The suspect was nowhere near the president's plane.

Smith says McVey's car had strobe lights like a police car might, but the suspect is not in law enforcement.

McVey is charged with going armed in terror of the public, a misdemeanor.

Smith says the investigation into what McVey was doing with a gun and why his car was equipped with strobe lights is continuing.

Anyone know what the actual law is on gun free zone near POUS?

sounds like a "gotcha" NC law.

Also... is NC an open carry State?  I'll bet it is.  Or else they would have charged him with unlawful carry of a weapon or whatever NC's version of that is.

Yeah, NC is an open carry state.  



"Going armed in terror of the public" is the BS gotcha law in NC that people get charged with when they don't really have anything to charge them with.  I guess there could be appropriate uses of the charge, but it does get used as a gotcha catch-all.



That said, if the guy intended harm to the POTUS, I hope he gets put away.



Conversely, if he was an unlucky innocent, I hope it gets cleared up soon.

There are four elements of Going Armed to the Terror of the Public:

1) arming one's self with an unusual and dangerous weapon

2) For the purpose of terrifying others

3) goes about on public highways

4) in a manner to cause terror to others.


The only real case-law regarding "going armed to the terror of the public" is State v. Robert S. Huntley (1843).

In it, the NC Supreme Court stated that, yes, a firearm is an "unusual and dangerous weapon", but the simple act of carrying a rifle or handgun is not sufficient to meet the threshold of going armed to the terror of the public.

The defendant in Huntley was armed with a double barrel shotgun looking for a James Ratcliff and was saying loudly enough for others to hear that he was going to kill him.

It is clear that merely openly carrying is not enough (regardless of whether the sheeple get scared), BUT, if you were to get loud, abusive, agitated, etc., then it is reasonable to believe you could be charged with GATTP

I had to wrap my head around that one, sounded like" I'm going out armed because I'm terrified of the public."

Any way, he should've been more careful while "brandishing" his arm, if it was just something as simple as moving it around on his person for comfort or whatever.
Hopefully he wasn't crazy, trying to be an assassin.

GATTTOTP is indeed a "gotcha" law here, but there are 4 elements you must meet to charge someone with this crime.  Someone will be along surely to quote chapter and verse.  In NC open carry is "common" law as opposed to "statute" law, meaning it's legal because it's not illegal.

Without pictures, How do we know it wasnt just a light bar like on a jeep or something. Its NC...Plenty of people have off road lighting.
I think there are too many laws that are set up to be the  "lets set an example out of this poor schmuck that had no ill intentions"  sort of deal
So a guy carrying a gun legally can be locked up on some BS just because obama is nowhere near? So that means anyone on the ground under the flight path of AF1 is a potential terrorist?

I find it hilarious that the board LEOs (God Bless them) never, ever, get into these threads and go "wtf?" even when it's obviously a blatant, bullshit, lets lock him up and then figure it out deal such as this.  Hell, I ALMOST would expect a few of the more liberty loving to at least say something like "well, with the info at hand it would appear that this is really bullshit, especially filing such a useless, catchall charge".  Says alot IMO.
