The bad guys lawyers filed a R.41 dismissal. In Ohio that means they have 1 year to start it all over again, but as of today it's over.
This entire thing was a bullshit bluff all along. We called them on it and didn't offer a penny in settlement. They knew they would never win at trial so they quit. They can refile, but their lawyers know its a lost cause and, and I can't imagine any other lawyers will want to pick this up and expect a different outcome. Thanks for all the support, it's been a wild ride, and fortunately the bad guys lost. To better understand how bad the trial would have gone for them read this - parents depositions. Imagine my attorneys cross examining them in front of a jury! Timeline June, 2 2020 link A Lucas County Common Pleas Court Judge grants a Restraining Order against Jerry Zohn as a result of a motion submitted by his wife's attorney which states " violence that occurred between them". Morning July, 2 2020 - link Allison and Jerry conspire to commit a felony when Allison asks Jerry buy a gun in his name for her and she'll give him the money, because she said she was a prohibited person due to being in a mental institution. Afternoon July, 2 2020 link Allison and Jerry follow through with the felony act and Jerry buys a .22 Ruger Wrangler Revolver which he gives to Allison. July, 7 2020 link Jerry(lives with a friend while going through a divorce) and Allison(lives with her parents) spend the night in a hotel 67 miles from their homes. Allison told her mom she "had her own hotel room". Jerry said they stayed in the same room, but in separate beds. July, 8 2020 link Allison kills herself using the revolver Jerry bought. July, 29 2020 link Detective Albright STPD speaks with the owner of ADCO Firearms and states Allison used the gun Jerry bought to kill herself. July, 30 2020 link to video Jerry Zohn is interviewed by Detective Albright STPD May, 27 2021 Jerry Zohn is indicted federally for lying on the 4473 June, 22 2021 link Jerry Zohn is arrested by ATF. December 22, 2023 Summary Judgment Motion January 4, 2024 Suicide Expert witness deposition - try to read THIS without laughing at the absurdity. January 19, 2024 Firearms Expert, Expert witness deposition - try to read this and this without laughing at this hack. Present Day They have yet to produce a single piece of evidence to contradict my statement to Detective Albright that there were no indications they were attempting to make a straw purchase. Extracts of Sylvania TWP detective interview with the 70yr old man on 07/30/2020 from Report 1255-20 “When I asked the 70yr old if he had any guns, he initially stuttered when responding, but eventually said, “Only one and this is one of the biggest mistakes I’ve made.” The 70yr old further stated that the 37yr old wanted a gun, but was afraid that she couldn’t get one because she had a history of being in a mental institution. I informed the 70yr old that the 37yr old was dead and it appeared that she killed herself with the gun that he had purchased for her. I explained to the 70yr old that he had committed a crime by buying a gun for someone that is prohibited from purchasing or possessing one and he replied, “I can imagine.” |

I'm almost 50 and I can only list 5 employers on my resume since I was 16. My CV is longer and I've been on the stand as an "expert" witness for some cases but I've always felt like I'm not an expert, I just have years of experience. Hoping this ends for you soon. |

Any LEO's following this case that have interviewed people regarding the death a close friend? Someone who in their words had a relationship with died suddenly.
Is this how people react? His tone/demeanor never changes throughout the interview. Does anyone actually believe he's hearing about her death for the first time? This guy spends the night in a hotel with his girlfriend, and then doesn't hear from her at all, zero contact for TWENTY TWO days. The Police find him and take him in to talk to him, and when the detective says , "This is in reference to a girl named Allison Roebke." Jerry's response was "OK" Wouldn't a normal non piece of shit person ask if Allison was ok? If not initially, at least in the first few minutes? He never once asked if she was ok. 13 minutes later in the interview when the detective asks about the gun he gave her his response was "Is there a problem with the gun?" Still no concern for the girl he hasn't heard a peep from in 22 days. I can't wait for this to all play out in court. Who on earth is going to believe a thing this convicted felon says? The Police find him and take him in to talk to him, and when the detective says , "This is in reference to a girl named Allison Roebke." Jerry's response was "OK" Wouldn't a normal non piece of shit person ask if Allison was ok? If not initially, at least in the first few minutes? He never once asked if she was ok. 13 minutes later in the interview when the detective asks about the gun he gave her his response was "Is there a problem with the gun?" Still no concern for the girl he hasn't heard a peep from in 22 days. I can't wait for this to all play out in court. Received the bad guys response to the motion for summary judgment. They are sticking to their fictional fantasy tale they wrote in the complaint.
Here's the introduction, I'll post a link to the full text later. PLAINTIFF’S MEMORANDUM CONTRA TO DEFENDANTS’MOTION FOR SUMMARY JUDGMENT This case turns on issues of material fact: whether Defendant Steven Thompson, owner of Defendant ADCO Firearms LLC and who is by his own admission an experienced firearm dealer, knowingly violated the law by willfully turning a blind eye to many red flags that made it obvious that a straw purchase was occurring, and whether the harm resulting from such an illegal sale was foreseeable. As discussed below, numerous other courts have considered these same or similar issues of fact and allowed cases to proceed, denying summary judgment when reasonable minds could conclude that the firearm dealer knowingly violated the law by deliberately ignoring red flags indicating an illegal transaction, such as a straw sale, and when the misuse of that firearm later caused harm. This case is no different. Defendants’ motion for summary judgment should be denied. |

Here is the bad guys response to the Motion for Summary Judgment
Making the same baseless claims has gotten them this far, why change their tune now. All the prior "similar" cases they cite, aren't similar. All those cases have phone, email, receipts, invoices or something connecting the buyers on a previous occasion/interaction with the sellers. In my case there is have NOTHING. Enjoy the read, and let me know how you'd feel regarding who is telling the truth is you were a juror. |

Since this will come down to your word against Zohn's it will depend to who the jury believes. It does help that Zohn is a proven liar and hopefully that will sway the jury.
I hope that the defense lawyers are good at jury selection and can weed out most of the anti gun people that could decide to vote based on their beliefs instead of the facts. What are the local demographics as far as liberal Vs conservative? Sure hoping for the best outcome for you. Its crazy how long these things take to get settled. It will be probably two years since you started this thread and four years since the incident. I can't image the amount of stress and aggravation you have been through. |

View Quote I have been told my personal attorney is amazing at jury selection. Lucas county is a blue dog democrat county, think of Jeep factory workers. The "liberals" here aren't anything like they are in Columbus or Cincinnati. This lawsuit is pretty well known in this area, and I hear from someone almost every day who says "my mom/uncle/grandma hates guns, but thinks your lawsuit is bullshit". No way are they going to get 6 out of 8 jurors to believe I'm the liar in this situation. |
