The bad guys lawyers filed a R.41 dismissal. In Ohio that means they have 1 year to start it all over again, but as of today it's over.
This entire thing was a bullshit bluff all along. We called them on it and didn't offer a penny in settlement. They knew they would never win at trial so they quit. They can refile, but their lawyers know its a lost cause and, and I can't imagine any other lawyers will want to pick this up and expect a different outcome. Thanks for all the support, it's been a wild ride, and fortunately the bad guys lost. To better understand how bad the trial would have gone for them read this - parents depositions. Imagine my attorneys cross examining them in front of a jury! Document Dump of the process Timeline June, 2 2020 link A Lucas County Common Pleas Court Judge grants a Restraining Order against Jerry Zohn as a result of a motion submitted by his wife's attorney which states " violence that occurred between them". Morning July, 2 2020 - link Allison and Jerry conspire to commit a felony when Allison asks Jerry buy a gun in his name for her and she'll give him the money, because she said she was a prohibited person due to being in a mental institution. Afternoon July, 2 2020 link Allison and Jerry follow through with the felony act and Jerry buys a .22 Ruger Wrangler Revolver which he gives to Allison. July, 7 2020 link Jerry(lives with a friend while going through a divorce) and Allison(lives with her parents) spend the night in a hotel 67 miles from their homes. Allison told her mom she "had her own hotel room". Jerry said they stayed in the same room, but in separate beds. July, 8 2020 link Allison kills herself using the revolver Jerry bought. July, 29 2020 link Detective Albright STPD speaks with the owner of ADCO Firearms and states Allison used the gun Jerry bought to kill herself. July, 30 2020 link to video Jerry Zohn is interviewed by Detective Albright STPD May, 27 2021 Jerry Zohn is indicted federally for lying on the 4473 June, 22 2021 link Jerry Zohn is arrested by ATF. August 24 2021 link Jerry Zohn files for bankruptcy October, 5 2021 Jerry Zohn pleads guilty in federal court to Counts 1 of the Indictment and is convicted under 18:922(A)(6) October, 14 2021 link Allison’s parents hire a Toledo law firm and open the estate to sue Jerry for wrongful death, but are told he has no insurance, so there is nothing they can put their hands on. March, 17 2023 link ADCO files motion to dismiss because the Estate was closed by the plaintiff on 09/09/2022 March, 20 2023 My insurance company of 20yrs and zero claims drops me. March, 28 2023 Plaintiffs reopen the estate. May, 4 2023 New insurance is acquired but at a 500% increase due to the open claim. June 5, 2023 Steve Thompson Deposition - Plaintiff cancels deposition at last minute. June 30, 2023 New Trial Date May 21 2024 July 21, 2023 Plaintiffs send settlement demand letter, state that their expert testimony will establish ADCO recklessly... August 9, 2023 Deposition Link Steve Thompson Deposition August 10, 2023 What a bold bluff! The settlement demand letter is rejected by defendant. October, 9 2023 Plaintiff Expert witness reports released. They're a joke. The statements made in the demand letter regarding said "experts" was a BLUFF. They have nothing. October 19, 2023 Judge denies motion to dismiss and states the closing of the estate was a mistake of the court. December 22, 2023 Summary Judgment Motion January 4, 2024 Suicide Expert witness deposition - try to read THIS without laughing at the absurdity. January 19, 2024 Firearms Expert, Expert witness deposition - try to read this and this without laughing at this hack. Present Day They have yet to produce a single piece of evidence to contradict my statement to Detective Albright that there were no indications they were attempting to make a straw purchase. |

The order the Settlement meeting was posted this week! I wish I was allowed to write the settlement statement!
1. ATTENDANCE OF LEAD, TRIAL COUNSEL IS REQUIRED. Counsel is required to be personally present and have full settlement authority. When the settlement decision will be made in whole or part by an insurer, the insurer shall have a representative present in Court at the time of the settlement conference with full and complete authority to make settlement decisions. A corporate party shall have a representative present in Court at the time of the settlement conference with full and complete authority to bind the company. A governmental entity shall have a representative present in Court at the time of the settlement conference authorized to act on its behalf. Failure to produce the appropriate person(s) at the conference may result in an award of costs and attorney fees incurred by the other parties in connection with the conference and/or other sanctions against the noncomplying party and/or counsel. At least three (3) court days prior to the conference, each party shall submit a confidential statement to the Court. The settlement statement shall not become a part of the file of the case, but shall be for the exclusive use of the Judge in preparing for the settlement conference. The settlement statement shall contain a specific recitation of the facts, an analysis of the law, a discussion of the strengths and weaknesses of the case, the parties' position on settlement, including the latest settlement proposal, and a report on settlement efforts to date. If not already a part of the court file, copies of any critical agreements, business records, photographs or other documents or exhibits shall be with the settlement statement. The statement should not be lengthy, but should contain enough information to be useful to the Judge in analyzing the factual and legal issues in the case. The parties are encouraged to be candid in their statements. 3. STATEMENTS INADMISSIBLE. Statements made by an party during the settlement conference are not to be used in discovery and will not be admissible at trial. Parties are encouraged to be frank and open in their discussions. The Court expects the participants to address each other with courtesy and respect. |

Zohn was convicted of a crime, one element of which is knowingly lying to a firearms dealer, Mr. Thompson. The only physical evidence of the events of the firearm purchase by Zohn is the 4473, which was completed and signed by Zohn, and submitted to and approved by the FBI NICS echeck system. There were no other employees or witnesses in the store, and no video recording. Mr. Thompson has an established, documented history of reporting suspicious purchase attempts to local law enforcement. Mr. Thompson was never questioned by any law enforcement agency beyond the initial contact, and no one in law enforcement has ever suggested he broke any laws. Mr. Thompson’s deposition testimony is consistent with what he told Detective Albright about the events of July 2. Zohn’s testimony varies greatly between his deposition and interview with Detective Albright about the events of July 2. Zohn showed no remorse when being interviewed by Albright. When told he was brought in for questioning about Allison, who he hadn’t spoken to in a month, he never once did asked if she was OK. When Zohn was told his gun was used in the suicide, he said, “I should have kept the gun with me and been done with it.” Zohn told Det. Albright the receipt for the gun was in his car. Payment for the gun was made with cash. Unlike a credit card payment, there are no statements with the name of the purchaser or card holder, or when payment was made. The receipt offers no proof of who the payment came from. While Zohn claims Allison paid for the gun, Mr. Thompson stated in his deposition that Zohn handed him the cash. If it was Allison’s cash, there is no way Mr. Thompson could have known that. Further, there are no bank receipts or statements showing Allison withdrew any cash that day in the court record. When Albright asks Zohn, “Do you wanna guess what gun she used to do it,” Zohn replies, “The gun that I bought her.” Zohn once again clearly states he was the buyer of the gun. Zohn told Albright, “She actually wanted a bigger gun. I said no, what do you need a bigger gun for to shoot at targets?” Zohn was in charge of the decision-making when he purchased the .22 revolver for target shooting. The plaintiff’s only witness is a convicted felon and an adjudicated liar, who lied under oath in his deposition in this matter several times. |

My sisters insurance company said the same thing until day 2 of the trial. Then settled for $75,000. Plaintiffs were suing for $750,000. Auto accident so definitely not the same scenario as here. I wish ADCO best of luck in this Trial. I know they will need it not because of facts but because of bias and political shenanigans.
I only have used them once when I needed a pin and welded flash hider removed. They did an amazing job and had a fast turnaround. The reason I was made aware of them was a post where someone was trying to do this themselves and failed horribly at it. ADCO popped in very early and made the OP aware of their services. They are very active on the forums. |

If insurers suddenly had to pay wrongful death claims for any merchant who sold the means by which the person took his or her own life, they would go bankrupt quickly - never mind the criminal acts involved in getting to that point. |

Normally I would kinda give the family a pass but in this case the Mom closed the daughters estate and then when they realized the fubar went back to the judge and said that is not what we meant even though she signed the forms. The other factor is based on family history these people were fuck ups over and over again with the cops called all the time. I thought there were some things brought up early about the father molesting the daughter that could have created her mental state but I could be thinking of some other case. I will say at this point it didn't happen until proven otherwise. |

View Quote How does this work in a personal injury case which I assume this is, where the lawyer gets a part of the settlement but not paid in advance. In the document he linked to the plaintiffs contract it said the lawyers will be constantly monitoring the case and its viability for lack of a better term in the last paragraph on the first page. It starts out about appeals but I would assume this is for the entire case and not just any appeal or possibility of one. |
