Man what total bullshit...the county shut down my local range over a toilet...
We have a porta potty out there, and its the cleanest one I have ever been in... |
We are looking into this...if anyone knows anything about this kind of stuff... any and all help would be greatly appreciated.
Unfortunately I was notified at close of business on a holiday weekend so we could'nt do anything. |
So what does "permitted septic facilities" mean? A porta-john isn't permitted? Fine, remove it. Problem solved. |
It sounds like Hays County wants Texas Tactical to pay them $$$$ for a permit to have a toilet/porta potty Sounds like "BS" to me! |
This is exactly what it is about. |
Its not like humans haven't been um....'going in mother nature's backyard' for millions of years.
Apparently Hays county knows better. |
Want to bet they have a new neighbor that doesn't like shooting ranges? Unless there was a complaint how would the health department know.
IRON MIKE:
Get you a "14.5 inch, black-Assault-type-Hi-Capacity tracer-armour-piercing porta-potty! Hellsfire! When I'm out working my fields on my tractor, miles from nowhere and gotta crap, do I go to the nearest porta-potty? I think not. Ask any extension service dude why the roll of TP is in your cab. Hay Cty chickencrap. -----Uvalde Boy--- |
Crap...good thing I came here - was maybe gonna go.
I did get the email - just hadn't looked yet - and might not have. EDIT: Thanks for the email Mike. Hope this gets resolved. |
That's my guess. I hate how folks will move out to an area, then try to change existing facilities in the area to their liking. Mike, keep us updated and let us know how we can help you out. |
Hays County....
From my experiences "It's a Whole Different World"... Stepping back in Time 30 years and 60 I.Q. Points!! BIGGER_HAMMER |
Sounds like my kinda crowd....I might be able to reason with them |
Mike,
Here is some info I found. Looks like it has something to do with the Edwards Aquifer. www.co.hays.tx.us/departments/envirohealth/envirohealth.php www.co.hays.tx.us/departments/envirohealth/pdf/haysoss.pdf Good luck. Kenny |
If a septic system is the problem, what about installing one or two Incinolets instead?
Must have a permit for Septic system, including 'porta potty' in this area of Hays county.
Did they not give a warning before having to shut down completely? Seems pretty harsh. |
No warning, just an immediate cease and desist decree. TEQ, are you in the know about this stuff? |
Mike,
Does "cease all busines" mean I can't drive to the range and do some plinking? IE: the range is closed until further notice. |
That's what I'm taking it to mean. It is probably better to be safe than sorry until I can talk to someone on Tuesday. I am so aggravated that I didn't get notice of this until the close of business on a holiday weekend. Talk about ruining a perfectly good weekend. |
I'm with ya on that.
I place no blame on you - understand that. Hope you're back up and running shortly. |
Jeez this blows.
I hope you are able to get this resolved quickly and with minimal red tape. How about inviting some firends out to shoot? That's not "business", is it? |
I am familiar with many of the zoning issues and permits, and am in Hays county. I'm not deep into the details, just been going through some of the research recently. What exactly do you have going on as far as this septic system? Just a porta-rental or is it a permanent fixture? Underground septic? They will most likely need to review the service schedule and maybe recommend the best place for the location of the facility. I know they are cracking down on the area just to ensure everyone is up to regulation on what's required to do business. I wouldn't take it personally. It does surprise me that they didn't get a notice/warning to you though, before recommending a cease all business activities. Haven't been to your range yet, but I'm planning to soon be an active participant. I'm sure this will all work out, but what a drag. |
We have a rental Porta Potti that is serviced once a week week wether it needs it or not. The waste is hauled off the property to be disposed.
We would love to have you come shoot with us as soon as this is resolved. |
Yea the porta potty out thier is the cleanest one I have ever been in...
Hopefully they just want proof that its not being dumped.... |
Contact them and ask them how they expect you to pay for a septic system when the business is shut down.
That might be it.....curious though how they found out....anti neighbor I am sure...and no notice, that blows!!! Good luck Mike, and I hope to see you soon! Travis |
Well.....so far no one including Hays County Health can show us any laws, statutes, ordinances etc. that we are violating.....
Were you able to talk to the person that issued the order? |
Well,
Did you talk to anyone? How about a local lawyer with some pull? |
Wasn't even a reference on the form/letter/bag of dog shit/etc they sent you? (kind of rhetorical, I guess ) |
He was not there today. Talked to another gentleman that said we should have been given at least a 30 day notice instead of the immediate cease and desist order. He could not reference anything that we were violating. |
I can recommend B2....he is the shit....hehe
He has also seen the range personally as my guest.... |
I have someone looking into this but I am sure we could use all the help we could get. Especially if it's free
Not sure if this would be a good idea - but it is an idea.
Fire Mission - at some point, swamp the County with emails. Not saying we should do it or that it is even a good idea, but it's an idea that I'm willing to run with. |
Good idea if Mike is OK with it. We shouldn't let these anti-gun and/or liberal and/or I-don't-know-the-law city officials test-scare us. Next time, they would gather enough support and shut us down for real. Like I said...It's Mike's call. |
Let me know. |
No good news. This is all part of a conspiracy by the "anti" new landowner and the neighbors. Hays still can't produce the ordinance that we are supposedly breaking.
The new landowner is also making completely unreasonable demands to try to shut us down. |
The people who own both the Garland shooting range (DFW area) and Eagle Peak shooting range (Austin area) went through years of litigation with new neighbors. The problems were with the Eagle Peak range. They may be able to help with info and maybe good lawyers. There have been some laws enacted in the past few years specifically to protect shooting ranges, so 'anti' neighbors are rather limited in what they can legally do. It sounds like they found "something" to gig you on and may have a sympathetic ear in the Hays County offices. If people in the Hays County office are overstepping their authority, then a good lawyer may be able to put the fear of "We, the People..." back into them. |
Mike...This is your land? |
Have you talked to legal counsel yet? I'd think if they can't produce the ordinance, and they are telling you they can't produce the ordinance, that you should be able to get back in business very quickly. |
So when did the land get a new owner? I thought the guy we were leasing it from was very pro gun....
When does the lease expire? This sucks....it was the last range that allowed me to shoot C3 within 120 minute driving distants.... So what are the complaints about? The noise? What if we got sound absorbing fences like some other ranges have used? |
Are we talking about the guy that owns the range land, or guys that own land AROUND the range.
Looks like both... Quoted: No good news. This is all part of a conspiracy by the "anti" new landowner and the neighbors. Hays still can't produce the ordinance that we are supposedly breaking. The new landowner is also making completely unreasonable demands to try to shut us down. Damn...That's sucked, man. The problem is really not from the city (since we can deal with)....but from the new landowner (who can just won't lease to Mike after the contract running out) and his/her neighbor. |
