Lame duck senate after Nov 3 can still confirm a justice, I believe.  I might be wrong, but I think Trump could lose and Dems could retake sen Nov 3 and Mitch could give a parting fuck you later in November.

That would absolutely trigger a court-stuffing attempt by the incoming majority and all hell would break loose.

The problem is, if he nominates, and for whatever reason the hearings and confirmation can't be held before the election, and he loses, then he will be, and the nom will not move forward in the senate between Nov 3, and Jan 20.
The risk of doing nothing is greater than the risk of failing, unless you believe this vacancy will galvanize us to turn out like we know it will them.

Here is my 2 cents:

1) It takes about 2 months from announcement to hearings, then another month for a vote on a USSC nominee.  

2) I expect Trump to name a replacement within a week.  It will be a "stellar" selection.  Instead of the dems running against Trump, now they have to run against *highly qualified judge and USSC nominee*

3) It is unlikely the Senate will  vote on the nominee before the election.  I expect McConnell to announce no vote until after the election.  But I could be wrong about this.  We simply don't have the sufficient majority to vote on a nominee before then.

4) VERY IMPORTANT: This takes the election out of the hand of John Roberts.  In a 4-4 tie, the lower circuit court ruling stands.  So what circuits are critical states in?

A) Pennsylania is in the 3rd circuit.  Trump/Mcconnell flipped that court to majority GOP control

B) Florida is in the 11th.  Trump/McConnell also flipped that court.

C) NC is in the 4th.  Majority "D" judges

D) Michigan is in the 6th.  Commanding "R" judge majority

E) Wisconsin is in the 7th.  Solid GOP majority.

Interesting times indeed...

Trump needs to submit his USSC Nomination 0900 EDST on Monday.

The "Biden Rule" has no standing in US Code or the US Constitution.

Murkowski (AK-POS) has already stated she will not vote for a nominee until after the election.

If Schumer and the demmunists would have done it, Trump should do it.

They would have packed the USSC regardless if Trump appointed another Justice or not.
