I didn't get into the details of every argument they've made yet, a few things pop out: 1) as mentioned above, many PA voters have been disenfranchised by the fraud that they aren't addressing. Don't know how, procedurally, that argument would play into the case in front of the court. 2) the separation of powers argument is interesting. Essentially, mind your own business, this is executive branch stuff. 3) On page 27 they quote Saucedo v. Gardner “Having induced voters to vote by absentee ballot, the State must provide adequate process to ensure that voters’ ballots are fairly considered and, if eligible, counted." as part of the reason why ballots can't be invalidated retroactively. That's only a good argument if Alito considers the absentee ballots to be eligible. Considering that he told them to segregate some of the ballots and purportedly they did not, he may not agree with them. Why include this line of thinking? Arrogance? Or maybe I'm just not getting it? I'm certainly not a constitutional law scholar. I don't even play a lawyer on TV. 4) They spend a lot of time relying on recent decisions ignoring fraud in other battleground states. The certified results only have Biden winning by 80,555 votes. I thought it was a bigger gap than that. |
