First things first: On a personal / humanistic level, I see this news and I shake my head that she specifically decided to refrain from retiring years ago, apparently deciding she wanted the first woman president to replace her. She fell for the broken polling in 2016 and made a decision that was basically nakedly political, and then spent the next half a decade getting propped up "Weekend at Bernie's" style while she was very ill. It would have been better for her to step down and actually have a retirement then what happened.
Second, lets get to the political, implications: Her decision was ultimately dumb politically (I heard from people close to the Obummer admin that they did put out 'feelers' to try and urge her retirement. Its a less on about personal myopic mindsets screwing with the result one claims to desire. I'm glad it went down this way, but damn... think of if Gorsuch was not on the bench and it was Garland instead!? As for what happens next, it goes without saying that Trump should immediately make the formal nomination of the most conservative and well liked of the woman judges on his list circulated recently. He should grind for the confirmation fighting just as hard as Obama did for Garland, pointing out that he was not part of the Republican establishment when the Biden rule was invoked etc. He should begin to highlight good TEXTUALIST / CONSTITUTIONALIST passages in their past opinions, without getting into specific issues... focus on the judicial philosophy. Right now, if Trump gave a press conference that said "Hey, those people are eating shitty used diapers from the dumpers; that's really gross. Tremendously gross," the liberal media would fill the airwaves with why its actually OK to eat out of dumpsters. So getting the focus on the constitution and textual analysis will naturally result in the liberal media talking about the 'living constitution' and abortion rights and all that shit and that helps Trump with his base and the middle of the road voters. If he's lucky and especially if the Trump base puts huge pressure on the senators, he might even get the nomination through. I kinda doubt it. RINOs love saying 'no' to their own party and the opposition will no doubt coalesce around Mitt Romney. But making a current pending nomination a part of the package can't hut Trump in my view in terms of motivating voters. On the other side, this will really rile up the lefties and no doubt result in them going even more nuts. Given what a pending SCOTUS seat did for Trump in 2016, its possible that this will enhance lefty engagement and turn out. Especially if Biden names a half-black, half-latina, wheelchair bound lesbian as his proposed pick when he gets into office. Its a hell of a development. What a fucking year. |
