| I applied for a UPIN because I've been waiting for 4 months on a form 4. I got denied in one day for what they say is a similar name and description committed a crime in 1991 that make me ineligible. I was 17 at that time. The only thing I can think of is a fight with my mom's drunk boyfriend. Thing is I wasn't arrested or charged with anything. I'm in the process of getting the record to see what the hell is going on. What's confusing to me is I've had my CCW for 20 years and have had to renew four times now. How the hell did that go through? I'm wondering if anyone knows a lawyer in AZ that can help me if it is me? This is quite frustrating. |

What did they actually put in writing as the reason for the denial? Have you read all of this? https://www.fbi.gov/how-we-can-help-you/more-fbi-services-and-information/nics/requesting-reason-for-andor-challenging-a-nics-related-denial You can pay an attorney to handle this for you, or work the problem yourself. You may need to get more info from the arresting agency of “the other guy” to show it wasn’t you. That can be sent in with your Challenge. |

As for CCW, I assume it is issued by AZ state or county you live in, so they probably do a better job (or easier access to in state records) than the fed contractor looking at your record, hence you having an AZ CCW. The feds only knows what the state sends to them. For example, if a state/local agency sends an arrest record, but not the disposition of that arrest, that can factor into false positive denials by the feds. The feds will not ask the state/local agency for anything, based on helping folks in years past with this. I generally tell folks to get the id history first, fix any issues (obtain documentation or agencies send info to fed). Then apply for UPIN, and if needed, submit "clearing" documentation already obtained. |

I might have to GI down this path. @movingalong How do you get your identity history? Complete a VAF and get your UPIN as a quicker and easier short term solution. VAF Also get your IDHS and get any outdated/incorrect/incomplete info in it corrected. It’s can be a much much slower process, but a more permanent fix. IDHS |
