I was under the impression that Braces were only legal for Pistols but not "pistol shotguns" aka firearms. Then I got an email from a large vendor advertising an 11" mag fed ar style shotgun sold with a brace. Can't find the email or photo. Is this legal now? |

IDK, I thought ATF still considered the “brace” thing to apply ONLY to handguns, not “firearms”. However, if a manufacturer is advertising factory equipped “braced” 12ga firearms then I would assume they really did their homework. Either that or they are really, really stupid. ETA- try to find a link to the specific product. Maybe someone better versed than me can run through the mental gymnastics of the legality. The difference between NFA legal or illegal often lay the subtleties. |

My understanding is that (federally) we’re back to the pre-[brace=stock] days so therefore as long as your 12ga “firearm” is 26” or greater OAL then it can have a brace, or just a rear pistol grip. (It just needs to never have had a stock.) Of course if you register it as a SBS (which is free since 1/1/26) then you can legally do whatever, except convert it to full auto. |

ATF's interpretation in their Brace Rule was that braces were never allowed on shotguns/firearms, so there was no $0 Form 1 amnesty for those items. That said, both before and after the Brace Rule, which was eventually enjoined by a Federal court, plenty of braced shotguns/firearms were sold. It's why none of the brace stuff made any sense - ATF could have called up SB or various other companies that were making braces more and more stock like, and said "Hey, this is too close, gotta dial it back", or with the 12 ga., say "No braces on shotguns". Instead they do nothing, and as I wrote in the comments, wait until the horse is not just out of the barn but out of the county, then come running out to shut the door. At this point, if you're in one of the OK states for the NFA ruling on SBS/SBR's, there's no reason to fool with a brace, instead of just putting a stock on it. |
