When adding a suppressor to a family trust, do all co-trustees need to be fingerprinted, or just the responsible person who owns the trust? Do you have to resubmit the a new batch of fingerprints and photos every time you add a suppressor to your trust? I know it's old hat to you folk, but I'm finding this process very complicated. All Responsible Persons need to do the fingerprints and the RPQ form. The ATF considers anyone in the trust whom can have control of trust property (i.e. the NFA items) to be a Responsible Person. That includes the Grantor and usually all Trustees unless explicitly worded in the trust that it does not. Named Beneficiaries are normally NOT Responsible Persons, as they don't usually take power over trust assets until it is executed. |

If you have 4 active trustees on the trust at the time of filing, you will need to submit a RPQ and fingerprints for each. And everytime you file another. BUT a lot of people create their trust with just themselves as a Trustee and then only have to do 1 RPQ and fingerprints. Then they create ammendment to their trust adding new trustees. Because this takes place AFTER the approval, there is no requirement to notify the ATF. |
