I had never done one before, so I used SilencerShop for the paperwork, no big deal, and the gun itself is pretty cheap originally, nothing special, PSA PA-15. It's getting engraved/stock assembled right now. I lack the vise and tool to attach a correct stock.
One of the things I was interested in was actually having this available for HD use, being short and handy...but I think I screwed up because I got it as an Individual, not a trust. So, if I have this right, I could conceivably have it on my side of the bed at night, but when I get up, since my wife and son aren't on the paperwork, I would have to lock it in a safe they do not have the combo to before I left the house, is that correct? This makes it kind of a pain in the patoot. So, if I am correct, since leaving it out would constitute constructive possession, can I convert it to a trust? Everyone who lives here is an adult and perfectly legal to own firearms. Or once engraved as an individual, is that where it stays? Tiny backstory - I bought this as a pistol because PSA Daily Deals...it was so cheap and I had this disposable income...and then discovered it was not fun to shoot at all. So when the stamps went to zero, I decided, what the heck. Even with the cost of paperwork, stock set, engraving and such, total $ in it is a couple of hairs over $600. Thoughts? |

| As long as the use of the firearm is lawful, who cares? That's even mentioned in the form "all lawful purposes". Now if you made 87 SBR's and had them in a storage locker that other members of your cell had access? That might be an issue. The lawful possession of an NFA item is just not a legal issue unless you've gone and done something monumentally stupid and they decide to try to play "stack the charges". |

You’re LE right? Constructive possession in this scenario works exactly like constructive possession of a CDS pill bottle. You can leave those on any flat surface in your bedroom (or anywhere in the whole house) and that’s perfectly fine. There’s no legal requirement to own a safe or anything. If the ATF (or DEA, whoever) wants to show up and charge your 18 year old son with constructive possession, you simply make a statement that it’s yours, and you left it there, and you were in possession and not them. Problem solved. You won’t have to solve anything because there’s no problem. If they use it in a home defense scenario that’s an extenuating circumstance. Could they be charged? Probably. Will they be? Idk about your jurisdiction, but around here they wouldn’t be. If they’re innocent of manslaughter (due to self-defense) then the state would have to prove they had criminal intent for the unlawful possession. |

Go to your approved Form 1, go to the electdronic documents tab and download your eft file, that's the file with your fingerprints. Once you have downloaded that you can file your own Form 1's without paying SS $50. |
