Those big ass dump trucks sure don't think so.

So this morning I am driving to work and a rock hit my windshield.  It came from a pickup a little ways in front of me.  I guess it came from the tire but not sure.

Anyways, I checked my windshield and there is a pit in it from the rock.  Not cracked yet but it might.  Check out the video and tell me if you think the other driver is financially responsible.  I am honestly don't know how these things go legally.  In a sense, it seems like it's not anybody's fault unless it flew off the back of the truck.  But it does suck if I wind up having to buy a new windshield.

The wide-angle lens of the dashcam makes the truck look farther away than it is.  The rock hits at 11 seconds in.

Usually no.   It means that you're driving too damned close to them.  If you were at an appropriate, safe distance...the chances of this happening to you are like close to zero.

Go to Wal-Mart, AutoZone, Pep Boys, etc. and lay out $5.00 for a repair kit.  Fix the "pit" yourself.

A lot of fail in that video

Most insurance policies have special ways of dealing with windshields. You won't get him to be held liable.

I would love to see some of your stops on dash cam.

As said earlier, USAA will repair most cracks smaller than a one dollar bill, free of charge. You don't file a claim, it's part of all their policies.  Now, if the windshield is not repairable, then you can choose to file a claim or pay out of pocket for a replacement windshield.  Call USAA, they'll book your appointment with SafeLite.  Bring your car to the nearest SafeLite for an almost immediate appt.  If you have SafeLite come to you, you might have to wait a while.

When I see a low-boy hauling a bulldozer (or other such excavation equipment) with all manner of debris falling off of the equipment onto and bouncing off the road with every pavement patch/bump they go over it would seem to me that the hauler would have some culpability if a person's windshield got cracked by said debris.

When I see such a rig on the road I give them a wide berth till I'm reasonably sure nothing is falling onto the road. Same with those 10-wheel dump truck convoys you see on the roads going 75 mph from some gravel pit to a work site......I find that I'm not as in near the hurry I thought I was.

Yup, and sometimes I sing along. No one wants to hear that, or my random gibberish.

That didn't work for me.  I met an oncoming dump truck.  Cracked my windshield so I turned around and followed him.  He had a couple inches of rock piled on the bumper.  Didn't bother sweeping it off.  He told me it wasn't his problem.  Highway patrol said the same thing.

IIRC if it touches the ground first no.

Nope.  If you can't secure your gravel, dirt load, you pay for it.  Don't clean of the dump lip or secure the gate ion your truck, you pay for it.   Don't clean off  the tracks on the excavator and drop shit on the road, you pay for it.

Of course he did.  And the HWP isn't the arbitrator of insurance claims, usually they don't know the laws they are enforcing.

My insurance company covers chip repair for free.  They sent me straight to Safelite and they "fixed" it on the spot no charge.  Maybe your insurance is the same.

Ok, I guess I should call USAA and check.

Before starting a thread on arfcom to determine 'financial responsibility'? Lol, That would be silly

But you guys know everything (collectively).  I'm sure to get a better answer here than from a random USAA operator.

As with many things...it depends on the state.  Here in PA you cannot get someone else to pay for it...believe me as this just happened to me yesterday.

My wife was driving my FJ yesterday and she was a few car lengths from the dump truck in front of us.  A rock came off the dump truck and landed right in the center of my windshield.  Caused a huge crack in my windshield and I'll have to pay the deductible to have my windshield replaced.  I was pissed, but nothing I can do about it.

As I stated above, Fjs are rock magnets. I swear, if there is a loose stone laying in the ditch, it will come flying out and hit my windshield like magic. I usually only wish for the rocks hitting the passenger side so  when the cracks start I do not have to replace the windshield right away.

Is that some kind of road rage prevention music?  I work with a guy who only listens to Hall & Oates when he drives for that reason, says it keeps him from getting road rage.

Actually, I like Hall & Oates!  That's a good suggestion.

I've tried doing my Rosetta Stone lessons in the car.  Those recordings probably sound crazy.  Had to stop because it was too distracting trying to listen to the pronunciation and repeat it.
