About 15 years ago, a young man with a handgun carry permit was stopped in the Nashville, TN area because a passenger in his car was known to have gang ties. During a search of the car, the cops found a legally possessed KelTec PLR-16 5.56mm pistol under the driver's seat. (Again, the driver had a carry permit and was legally carrying the gun.)
The cops, wanting to fuck with the guy hanging out with a childhood friend who had gang ties and not being familiar with the PLR-16, decided to charge the driver with possession of a prohibited weapon-to wit, a short barreled rifle. The kid was too broke to hire his own attorney, so, despite knowing full well the PLR-16 was marketed and sold as a pistol, agreed to dispose of the pistol to an FFL in order to have the charges dropped. The gun was sold to a gun shop in Nashville (Eastside Guns), where it was bought by none other than ARFCOM's own, the infamous kwikrnu, aka Leonard Embody. |

It's always about disarming of law abiding and taking their $$. When I did a job at the Queens DA's ofice years ago, I saw a whiteboard with info listing an out of state traveler getting busted at JFK for having a handgun, magazine and number of rounds. The board listed that the traveler has a concelead carry in his home state, was traveling from A to B and "forgot" he had his firearm with him. The solution on the bottom of the whiteboard said, agreed to the charges, loss of firearm, mag and ammo and fines. Which I'm sure were huge.

The total for multiple misdemeanors does not add up to make you a prohibited person. Also misdemeanors with a penalty of up to two years are exempt from making you a prohibited person. It says that right on the 4473 in the instructions. To be prohibited it needs to be a felony or a misdemeanor with a penalty of over two years. |

He said he’d ask his lawyer about getting a copy of the affidavit they used to apply for the search warrant (another redditer told him he could do that). So maybe we’ll find out more. |

He was told, “We still have three years to press charges, so don’t ask again”. DA refused to press charges against the guy who broke into his house. BIL waited two years before finally paying his lawyer to demand his guns he returned. |
