Cops get a call for a drunk driver, with description of "brown haired guy with 3 year old," and attempt to ID a dude with the 3 year old. Dude knows his rights and refuses. Cops threaten to take his kid and arrest him, and then arrest him and take his kid.

The shocking conclusion: The SGT showed up, actually knows the law, manages to actually do the right thing, and cuts him loose.

8/10 for Jack knowing his rights, but should have called for a supervisor immediately.

2/10 for cops arresting for refusal to ID.

7/10 for SGT correcting the idiocy of his supervised.

From what I remember, in Texas you have no duty to identify yourself while being detained and is only unlawful if you lie about your identification.

Perhaps I am wrong though.

I've always looked at "I want to speak to your supervisor," the same as, "If you're an undercover, you have to tell me if I ask."
In many places, you don't get to ask to see a boss.

From what I've ascertained from body cam footage of these types of incidents, while there may be no "right" to see a supervisor, the supervisor being present is usually helpful for everyone involved. I can't think of any that I've watched where the supervising officer didn't show when asked.

It may be policy at departments in some lib areas. When I see it happen in auditor videos, there's usually no crime or RAS to hold the person, so the cops seem happy to call the sup and have the person stick around longer while they wait on them to get there.

Yeah, just finished watching the relevant parts and they supervisor confirms this.

I'd give the supervisor some credit for knowing the law, but he hem haws around about it and even has the officer that arrested the dude tell him that he should give his ID even though the law doesn't require it.

It blows my mind that this very basic understanding of the law on how officers should interact with the public isn't known by police officers.  Arresting someone for not breaking the law should be much more serious than how they let that play out.  Something of that magnitude in my profession would have severe repercussions.

Trying to piece it together, but the audio isn't all that great.  It however appears that one of the arresting officers understood he didn't need to show his ID but also didn't object to the arrest and participated in it after the call to arrest was made.

It looks like these police men are in need of further training on investigation and confrontation management.  I think the citizen needs to start by talking to the mayor of the city and the police chief.  I could see a way of not suing the police department provided they took out an add in the local paper and local radio station admitting what they did is wrong.  I've encountered a common situation years ago that I handled by not arguing with the cop on the street.  I requested his immediate supervisor to meet me at my home to discuss the matter.  To their credit they did send the his supervisor to talk with me on my front door step.  I can somewhat identify with the cops in that video, however, this is not the way to provide quality law enforcement services to the community.  In my eyes, I am more concerned with their lack of training.

LOL At the end, what looks like a manager that just walked to the scene after it was over and seems to know one of the cops and says, "You let him walk away? What the hell?" He didn't even know or understood what happened but seemed bummed that they let the guy go. What's even sadder is he's not the only who has that ignorant mentality.

I had something like this happen years ago .    Except that it involved one of sons .

Cops showed up at the front door one morning and said that they had a report of someone vandalizing cars in the neighborhood .   And they had a tag number .  And a description of the person .  Supposed to match my son.

They proceeded to try and hand me a long line of BS .

Finally after I had a much of their lies as I could stand I called my wife and brought her up to speed on the happenings .   And I made sure to reaffirm how the car was titled .

I turned to the officers and told them to leave my property as quickly as they could .

You see all our cars and trucks are titled in my wife's name .  And have been for years .

Busted .

A couple cops show up to a Walmart in Texas after someone called to report an assumed intoxicated driver with a young kid. Said cops jam up a guy they see in the store, ask & pressure him to show ID, which he refuses. Cops get physical, cuff him, jam his throat against a cooler & take his ID out of his pocket. Little kid is right there watching until Walmart lady grabs him to console.

Cops put him in the patrol car & proceed to discuss said happenings with their sargent. Sargent discusses what happened & why, fishes if there are any offenses besides not showing ID that he can be arrested for, then proceeds to tell the arresting cop to let him go with a 'there was a misunderstanding of the law...' explication.

Dude got protected & served...
