In California, a cop who wore a gun belt for at least five years and has a low back injury is presumed work related. How do they lie to a cat scan or mri?

I can’t hear shit , especially with background noise and having ringing in my ears. The VA says I can hear fine. I was an infantryman that engaged in close combat and was IEDed multiple times. So I dont know how people get such high ratings. Maybe they use lawyer/doctor hired guns? I don’t know.

And they completely fuck things up for those who are legitimately hurt on the job.  I have a close friend who completely destroyed his back on the job, and he went through years of bullshit trying to get it covered properly.  He ended up retiring on disability, but that is not what he wanted - he truly lived and breathed being a firefighter.

The WC folks start out with the presumption that everyone is faking, and rebutting that can be close to impossible.

Know a guy that was in the coast guard then went to a major PD. He's now on 100% from Coasties and 80% from the PD...  BJJ classes twice a week.

There's a lot of poor understanding of the VA system in this thread.

Scammers aren't taking anything away from vets that need it, they're taking away from tax payers.

Vets that have disabling injuries that aren't getting compensation are almost exclusively vets that try to do it without a VSO and then refuse to follow up because they feel like they are being screwed. You wouldn't land nav without a compass, don't file a VA claim without a VSO. This is second only to those who wait a decade before filing and no longer have the documentation to prove something happened or when.

The VA is really 2 distinctly different organizations , the VHA and the VBA. Your interactions and experiences with one will NEVER automatically trigger anything in the other. One is for healthcare (VHA) the other for.benefits (VBA).

The VA is an imperfect system and I'm glad fakers are.being caught. That said, it's done a lot of good for a lot of vets.

100% from Coaties?  What does that mean?  Are you inferring that he is 100% from the VA due to his time in the Coast Guard?

As to the POS in the OP, I hope they break it off hard in him.

Hearing loss is hard to rate above SC 0%

Persistence pays off. always have an active intent to file open. If you get a denial, obtain new evidence and file a supplemental claim. If you are under rated for a condition that has worsened, gather evidence and file for an increase.

What medical conditions are you currently suffering from with a current diagnosis? Are any of those conditions presumptive to your location of service?

Sounds like he’s 100% scheduler from active duty coast guard service. There are no work restrictions for 100% if your combined rating, using VA math, add up to 95%.

A lot of vets have made abusing disability into an art. I got invited to a veterans page on FB. Every other post is about their disability rating, how to increase it, etc. Each is filled with comments telling them what symptoms to complain of, what associated ailments to shoot for etc. It’s really pretty disgusting. The abusive shitheads get tons of disability and those the program was developed for get undercompensated and I hate it.

Is their disability compensation based upon not being able to work out?

Lots of disabled vets treat their mental health conditions with intense exercise.

I have a friend who lost both legs to an IED in Iraq. He's rated 100%, but is still very physically active. He runs with the use of prosthtics, competes in obstacle courses, bowls, and rides one of those bikes you pedal with your hands.

He's physically capable of doing it and serves as an inspiration to a lot of people. Should he lay in bed and make his family wait on him because he gets a monthly check from the VA?

Or, do you think the government shouldn't pay him for having lost both of legs and the other health issues he has as a result of his service since he's found some activities he can still do?

VA disability compensation isn't welfare. It's supposed to be reimbursement because the government borrowed your body for awhile and returned it to you in worse condition than they got it. It's no different than you expecting restitution if your neighbor borrowed your truck and brought it back damaged. Unfortunately, there are douchebags like the guy in the linked article who don't have integrity and who lie to take advantage of the system. Thankfully, when they are caught, they are punished, unlike people who make false criminal accusations, who aren't punished for fear of scaring a real victim out of coming forward.

I doubt the couple at work have shared with you the whole story about their disabilities and ratings. For all you know, he could have been raped in the shower and has ratings for both MST (Military Sexual Trauma) and PTSD, neither of which would preclude someone from working out. She might have been exposed to hazardous chemicals or maybe she watched a friend get vaporized by an IED and now uses bodybuilding as a way to get the most out of her life after realizing that life is fleeting and can be taken without warning. Or, they could be completely full of shit and are scamming the system. If you have proof they are, do us all a favor and report them to the proper authorities.

By that logic, shouldn't every job I've ever had pay me forever?

Yes, we should not pay him.
Outside the U.S. military, what other jobs pay you can work four years, then draw welfare for the rest of your life, and maybe your spouse's life?

I'm not saying that we kick our injured soldiers to the curb.  What I am saying is that giving a guy a check for life is not the right way to help them.

I would rather spend time and money spend on rehabilitating and bringing people back into being productive humans.

In WWI, the Germans took soldiers with shellshock and set up towns for them and gave them jobs, a paycheck, a lively hood.  A man who shakes so bad he couldn't hold anything steady was tasked with spreading feed for chickens.
I believe something similar would be better than just paying these people to stay home and do nothing.

Imagine a program that worked to rehab injured people, then find them a useful and productive job that they can be proud of.  But we won't do this because it is harder than just cutting people a welfare check.

Worker's Compensation

There are also union disability pensions, Social Security disability benefits, and private disability insurance policies.

VA disability benefits aren't welfare. They are an agreed upon part of a contract between the servicemember and the Federal government. As for the widows, blame President Lincoln. He's the one who promised to take care of soldiers, their widows, and their orphans.

We disabled veterans aren't paid to sit home and do nothing. I get about $850 a month right now because I developed cancer while in the Army, followed by exercise-induced asthma, and also developed issues with my feet. I'm not getting paid to sit on my ass. I'm getting paid because prior to joining the Army, I was a competitive swimmer and now I can't swim more than 10 yards without running out of breath. I used to be able to hold my breath long enough to swim 100 yards under water. Once I developed breathing issues in the Army, I could no longer do that. If you've got some magic way to make those breathing issues go away, I wish you would. I fucking love swimming and can't do it anymore. I also either rode a bike or walked pretty much everywhere I went. I was in great physical condition because I was active. Now, I have health issues because any kind of sustained aerobic activity is almost impossible.

Oh, and the VA did pay for me to go to school and get an accounting degree, which I now use every day as an IRS-credentialed tax preparer. But, that piece of paper doesn't allow me to exercise the way I used to. I gave up being able to do what I love bcause I got sick while in the Army. The Army and the VA ruled that it was connected to my time in the military and that the VA should pay me for the loss of quality of life I experience every day for the rest of life (or, at least until you invent some way to make asthma completely disappear).

I'm not out there making fraudulent claims of PTSD, MST, or sleep apnea in order to up my rating so I can get more money. I'd love it if I'd gotten out of the Army and were still able to do the shit I loved to do. I'm also not out here lining up for free meals at Crapplebee's the second week of November. But, I sacrificed my ability to enjoy my time off and the least the government can do is pay me for that sacrifice. When I can once again swim 100 yards underwater on one breath, the VA can stop paying me.

Yea, they do. As should you. If you have become disabled during your time in service and it’s service connected you should hire a law firm that specializes in that the receive the disability you are entitled to.

Please tell me who held a gun to your head and forced you to join the Army.  We should extract retribution from that person, not the tax payer.

Or was that your choice?  You choose to make a sacrifice; you should live with the consequences.  There are any number of safer alternative jobs you could have taken.

If a woman choose to be a prostitute, then got a STD, is it the governments fault?  Should the tax payer provide her medical services for life?

Unions do a fair bit of good stuff, but also many of them are crooked as fuck, pro-socialist, etc.  Social Security is a broken program that is also abused to hell.  Now, I have no issue with private insurance, that is the option I feel all people should use if they live a dangerous lifestyle.

SiVisPacem, you feel justified to suck at the government teat just like all the welfare queens that vote democrat.  I'm sure the people on food stamps, unemployment, etc. all also lie to themselves that they earned it.

But this is what I feel, and I know it is the unpopular opinion.

//-------------

Some years back there was a news article about an investigation into some fire dept. in NY (IIRC, might have been a police dept.  Pretty sure it was NY and fire dept.  Read about it here on ARFCOM).  Nearly everyone from that department that retired was retired at full disability.  I want to say it was something like 98-99% of the retirees were classified as disabled.  Turns out the retirement program for that job sucked, and paid almost nothing.  But if the individual was flagged as disabled, they got a respectable retirement.  So, someone was hooking up the people and doing the paperwork to retire them on disability so they would get more money.

Well, I suppose that there was that 1-2% or so that didn't get hooked up.  Must have pissed off the wrong person.

But, the way I see it, unless these individuals are actually disabled, it is fraud.  These people signed up for this job, and knew that it had a shitty retirement plan.  Then, when it came time to retire, they gladly put away their morals to fraudulently take a higher disability pay.

Instead of doing something like pushing to improve the retirement program of that department.

Whelp, I guess those fine folks are like our military troops.  Morally bankrupt when it comes to monetary handouts.  I know I am, I'm getting those VA direct deposits too.

Yep, I willingly signed the contract, fully knowing that one of the provisions in that contract was one which said the VA would provide disability compensation for me if the Army fucked me up.

I didn't join the FDNY or NYPD, so I don't give a shit about their retirement systems. I cared about the promises made to me by the entity asking me to come work for them. They offered pay, vacation, travel, college money, retirement benefits, and disability benefits if needed. They offered, I accepted. As it turned out, I ended up needing to use the benefits they offered.

If a prostitute enters into a legally binding contract with her pimp and, as part of that contract, the pimp offers a disability compensation package in the event of getting an STD, I damn sure would expect the pimp to live up to the deal.

If you and I made a deal on the EE for a trade, you'd damn sure expect me to live up to my end of the deal, right? I can't just say, "Well, Postal0311 knew there was a chance I wouldn't ship, so he's fucked. Maybe he'll accept my advice on how to find another item like the one I was supposed to ship, instead." A deal is a deal. I made a deal with the Army and I expect them to live up to it.
