You would think that for something like this to be a crime, that there would need be some kind actual negative effect for the "victim" first. Maybe this should be some kind of civil infraction punishable by a moderate fine. I know, I know...double standards
edit: I just reread the article. If she was so drunk that she doesn't remember what happened, does that mean that she couldn't consent and the kid is really the criminal?
