This one hurts. I really expected better from Kavanaugh. If the Dems take back control of the Capital and appoint a new ATF head.... you better believe they are going to come after AR15s. The argument will be they are "readily convertible" to machine guns. Doesn't matter if you own a Lightning Link or not. Because Lightning Links exist, your AR15 has the potential to be a machinegun which now means it legally is a machine gun. Based on this opinion if you own a 3D Printer you technically already own a Glock clone, because someone with very little machining knowledge could potentially hit "start" and have the machine spit one out. Not someone who voted for him because he was the best pick of the two. And I give Trump credit when he does something of substance. I gave him credit the other week for moving the gun rights restoration process from ATF to the Justice Department which bypasses Schumer’s 1992 ban on processing the applications. Waiting to hear when that program is in play. |

Abolish the NFA and the CGA. The NFA is the product of the 20th century period where fascism was popular, it's up there with prohibition only it was never repealed. The CGA is the product of the 1960's social progressivism similar to Johnson's "Great Society" and other federal overreach. |

Whether "a weapon parts kit that is designed to or may readily be completed, assembled, restored, or otherwise converted to expel a projectile by the action of an explosive," 27 C.F.R. 478.11, is a "firearm" regulated by the Act. 2. Whether "a partially complete, disassembled, or nonfunctional frame or receiver" that is "designed to or may readily be completed, assembled, restored, or otherwise converted to function as a frame or receiver," 27 C.F.R. 478.12(c), is a "frame or receiver" regulated by the Act. Wonder if the DoJ under Bondi could have intervened to headed off this ruling if it hadn't have been granted and argued under the Biden DoJ. (post edited/updated) |

Not surprised. 5th Circuit kind of "activist court" on this, and the USSC was never going to uphold them on this one. USSC is walking an odd fine line. Of Thomas instruction to view based on 1840-whatever practices, and the rest of the court not wanting to just toss all the laws on the books just like that. And so the court is defaulting back to their usual state - of not-rock-the-boat. Maybe if Soto retires, Trump can get a Thomas level firebrand in there. The last 3 were OK, but only OK - some of the time. Shit, the one place I think Patel would be pretty useful. |

JUSTICE SOTOMAYOR’s suggestion that I have mischaracterized what the Court has held, ante, at 2 (concurring opinion), demands a response. Although JUSTICE SOTOMAYOR obviously wishes that the Court had gone further, all that the Court has actually held is that the ATF rule is not facially invalid because at least some applications of the rule are consistent with the statute. And the two examples that the Court cites are (1) a kit that contains all the parts needed to make a semiautomatic pistol and that can be assembled in 21 minutes, see ante, at 8–13, and (2) a frame that can be made functional simply by clipping off two plastic tabs and drilling a few holes, ante, at 17–18, 21. The Court has not held that any other kits or presently non-functional receivers are covered. |

Anyone who's ever made a spud gun knows that PVC pipe is readily convertable to expel a projectile using an explosive. So serial numbers for pvc pipe? Background checks at Home Depot? If I need to cut it down to fix my sink do I have to SBR it? Seems like sloppy, wide open wording from SCOTUS. |

I can take a PVC pipe, a tennis ball, a can of hairspray, and a lighter, and have that going in well under 21 minutes. So where did that metric come from? And what other criteria are involved in it's selective application? |

So… now atf can claim making your own, homemade firearm, for personal use is illegal unless registered? What’s next, you want to write a book / speech / text / social media post you have to pre register it with the FCC etc before you can write it? Because that’s the same infringement in regards to violating our first amendment rights / second amendment rights. |
