The Supreme Court has already ruled that freedom of speech limits the abilities for a public official to sue for libel/slander.... Current or former public figures get little to no protections.

This is why biden can't sue you for talking shit about him either..

Sorry to stomp on everyone's parade. This will go nowhere.

I don't think showing the "actual malice" component would be all that hard to prove. It was pretty clear to anyone watching from 2015 on,  that CNN and it's employees had a seething hatred for Trump and tilted every mention of him in a way that would hurt his reputation

The fact is that if it gets dismissed it will confirm for many that justice is in fact dead, at least for now.

That is the exact purpose. It feeds confirmation bias and supports Trump's branding as the guy who everyone is out to get.

Yep this.. I don't think he even cares if he wins (or figures he even will). It's more about a message.. A punch back.  I don't think he needs the money at all. I also don't really think this thing will go the distance either. Sometimes you just gotta kick em when they are down to remind em who they are :)

The real question is why did it take him so damn long to start fighting back?  Seems like this should have been news way before now.

Last time Trump tried to do legal stuff he hired the three stooges to be his advocates… and it made him look dumb. What are the chances that he did better this time around?

Oh, now we support defamation laws and hate free speech?  It's hard to keep up with the flip-flopping around here.

Surely to Christ, you're aware that "free speech" only keeps you from being arrested by the government for the content of what you say, right? It doesn't protect you from being sued into obliteration, or getting the brakes beat off your ass for slandering people.

I expect most of GD to not know the difference, but c'mon

Free speech has a much broader context beyond just the first amendment.

He is probably thinking if he wins they will have to turn over the network.

Who knows if Trump is really even expecting to win. He may just want this to get to the 11 Circuit; to 'shake the bush'. Eventually a court is going to have to say that he (a public figure) doesn't have the same rights as the rest of us, even if they're lying.

The focus should be on "intentional" and "malicious".

What are the real damages in the Jones lawsuit? I think Trump can argue significant damages.

Yes. Though it is a concatenation of two separate legal definitions that both applied to his case;  those being  "involuntary public figure"  and "limited purpose public figure".

It's an interesting legal area.

It doesn’t matter if you don’t think there were real damages.

Intentional infliction of emotional distress is an established tort.
