Just a thought: if a replacement before the election gains steam, the dems might frame it with a threat to simply expand the number of justices next time they are in total control (which, frankly, MIGHT happen soon). Now, they could try to do this anyways, but they would have a lot more leverage if they use this opportunity to “legitimize” a simple SCOTUS expansion out of thin air as retaliation. It’d be like a nuclear response for the nuclear option.
Just a thought....STILL, probably best to jam a good appointee through NOW. |
