Talk to your sons. Explain how statutory rape laws work. Explain that it is often strict liability. Only two questions - what was her age, and did they have sex? The age is an objectively verifiable fact for the court. Whether they had sex or not can be a swearing contest. A swearing contest the boy often loses. Counsel them not to hang around with under aged girls, don't buy or give them alcohol/drugs, and don't have sex with girls that are potentially under age unless you are absolutely positive of their age. Absolutely positive. As in, ready to bet 5 to 10 years of their life plus a sex offender label. That type of certainty. |

I don't know what the laws are here, but this same kind of thing sort of happened to a guy in my platoon back in '02.
He went to a strip club and he got himself a stripper girlfriend. He was one of those dumbfucks that never listens to anyone and make all the obvious mistakes but yet can't stop complaining about them. Yet, at work, he was a complete follower. Well the MPs along with some Fayetteville PD came and rounded him up from the company area one day. He came back late in the night and we got the whole story and he had to participate in the next 1 million safety briefings. It turns out his stripper girlfriend was an underage runaway.....16 I think. Of course he was an idiot and admitted to everything and didn't have a lawyer. It turns out though that he didn't commit a crime because of the circumstances in which he met her----as a stripper. She was stripping at Sharky's/House of Dolls/Pure Platinum (whatever the fuck the name was, it changed like every 6 months. Probably after every bust) with a fake ID so I guess in the eyes of the law he was good to assume she was not a minor. He still got cuffed and detained for over 8 hours. |

There is seemingly no end to the 16 year olds that would line up to have sex with me for money. Even if they came to my front door uninvited. Out of the blue. Age of consent in TX is 17. So he could lay the pipe no problem, no laws broken, etc. ( I thought she was 17?)

Doesn't matter who initiated it. There is seemingly no end to the 16 year olds that would line up to have sex with me for money. Even if they came to my front door uninvited. Out of the blue. Accompanied by a Catholic Priest, a Baptist Minister, and a Voodoo practitioner of high regard. All of whom swore to her being of age. Again, only two basic questions. What was her age and did you engage in a sexual act. The basic law in most states (and in Texas) is that it is my responsibility to know she is of age. Not think, not hope, not believe, not understand. Know or face the consequences. Hence the term "statutory" rape. You are guilty even with consent, even if she lied, even if everyone would think she was of age. Since this occurred on a sugar daddy web site - younger women having sex with typically older guys in exchange for financial compensation - WTF was this idiot thinking? He needs to be extra careful on those sites.
