There was a cop in NY who had a crook run into his house. I think after a failed entry where a swat team member accidentally killed another cop the house ended up burning down after they fired gas canisters or whatever into the house. Rumor is crook was dead but who's going to order a second entry

The court acknowledged that this may seem “unfair,” but when police have to protect the public, they can’t be “burdened with the condition” that they compensate whoever is damaged by their actions along the way. By this theory, a police officer would never risk damaging a police vehicle or other equipment, which is overtly not how it works. |

It sucks that we have to deal with the costs from these shitbags. They should be forced to work in labor camps until full restitution is made to their victims. Should have had insurance. The police destroyed property to protect life. I am ok with that choice.

 You can’t be concerned with property damage in the moment but when all is said and done there is a responsibility to make things right. He needs to appeal that to scotus. If a city can pay 19 million for some gay comment this department can buy them a new home and compensate them for the last 5 years.

FWIW, the GVPD chief is a real piece of work.
Told me suppressors are not for hunting and asked why I needed one and also wrote the first letter to the ATF on pistol braces.Best to ventilate armed intruders on your own accord round these parts. |

That is super fucked up, both places I have copped at had a risk management department that would come out and survey damage and cut a check for damages we caused to third party property in the course of doing business like kicked in doors or broken windows
They wouldn't pay you if you barricaded in your own house or whatever but if we had to boot some old ladies door cause she fell down or bust into a lockout apartment complex for a DV in progress or something they never gave anyone problems with reimbursement. |

When I started fresh out of law school at a small firm, I had a case where they were filming a Cops episode. The police were going to serve a warrant. Right off the bat, they launched tear gas through the windows, ripped the door off, burned part of the house down.
Not only was no one home, it was the wrong house! Suspect lived on a different street. Too bad the city said and refused to pay the damages to the homeowner. Don't know how it turned out, left that place before it wrapped up. |

They need to be compensated such that they have their house and possessions back just as before. The CITY be forced to have some kind of insurance policy to pay for these things. Is that not a thing? We're forced to buy car insurance in case we fuck up. These municipalities should have to as well. |

I don't believe that violence will solve much, but if the gov't/police leave someone with little left to lose, as in that situation....
Well, that's a dangerous situation, and it disheartens me that they do not see the danger in it. They are lucky that the homeowner is a civilized man. I feel that government could use this precedent to sidestep eminent domain, or at least save themselves a few bucks. "We thought there was a bad guy in there!" as bulldozers crash through the front door. "well, that house is only worth $5k for the lot, even though it used to be a $400k house right where we wanted that new police station to go. Here's your check." |
