Its interesting how they equate "employees should ask a couple of questions" with "ADCO failed to pepper them with questions."
It should be pretty easy to turn things against the plaintiff when their complaint is so full of extraneous and subjective BS. That and there's plenty of room with the way the complaint is written to suggest that the plaintiff is disparaging of atypical couples or relationships. Legally it doesn't matter, but pointing out how aghast the plaintiff is about the age disparity and "odd dynamic" between the two and how that shows that the plaintiff is clearly biased, bigoted, and closed minded about modern interpersonal relationships whereas ADCO is not might appeal to people on the jury. Heck, I bet you could argue that their complaint is fundamentally flawed as an "adoring father" should have known his daughter bought a gun, and that it is far more his responsibility to prevent her death than ADCO's. I also wonder if you could successfully argue that if the complaint holds that ADCO is filling the role of law enforcement as they hold a Federal license, then ADCO should be counted as federal law enforcement and as such should enjoy the protections of qualified immunity. After all, many many court cases have ruled that the government has no responsibility to protect individual life, even when action/inaction on its part demonstrably causes loss of life (Uvalde anyone?) If the government's system does not adequately prevent straw purchases, then any negligence is on the part of congress, not those tasked with enforcing flawed policies. But i'm not a lawyer and didn't sleep at a holiday inn express. In any event; to hell with ambulance chasers. |

The notion that you're liable to a woman who committed a felony and evidently recruited a second person to commit another felony to aid her in the commission of a felony is disgusting.
This allows the felon (or at the estate of the deceased) to profit from her crime. I'm sorry you're going through this OP. It's bullshit. |

This should get tossed because it's only a straw purchase if the gun store knows the buyer is purchasing the firearm for a prohibitive person.
It doesn't matter if the prohibitive person is in the store with the buyer or sitting at home. ADCO didn't know it was being purchased for someone else . Good lawyer should get this tossed out, |

So a quick read of the police report says that some idiot straw purchased a gun for a crazy chick and she killed herself with it.
If anyone is liable then it would be him. I'm sure these 2 weren't the first people you've had come into your shop that seemed "odd". Probably going to cost you a bunch in legal fees but you're not liable if you followed all the rules. Hopefully you can counter sue and recover your losses. You've been a long time contributor here since before I joined this site and hopefully this community/site supports you as well. ETA: IM sent I'm in for $100. I've spent that for the larue/Nolo fund before, maybe they can do something as well. |
