Subsequent cases have held close to that. The administration is not without discretion but it also can't exclude outlets or restrict press passes based on the outlets editorial viewpoint. This round of exclusions will be challenged in court and the Whitehouse will have a really hard time defending it. It doesnt help that Trump has openly stated the restrictions are for reasons prior cases have found aren't legal. Trump stated this was due to their deceptive and false reporting, then provided a long list of deceptive and false reporting by CNN. That sounds like it is evidence based vs the MSM's "without evidence" mantra. |

Has anyone watched the press conferences? People are jammed into that little room shoulder to shoulder. No room for anyone new without throwing someone out. Maybe Trump should promise to move the press conferences into the new ballroom. Then everyone who claims to be 'news' could get in. And these liberal media and judges trying to prevent it from being completed would suddenly change their tune. |

What they publish, regardless of veracity, is protected first amendment speech. The language in the landmark case is 'requires that this access not be denied arbitrarily or for less than compelling reasons.' It goes on to cite cases that help define that, but it essentially boils down to security threats. Moreover, whatever the reason the process used has to be documented and adhered to, which doesn’t seem to be the case here. Contrary to popular wisdom there's no real obligation that the press publishes pure fact, or that is must do so with balance. Freedom of the press means that, with some narrow exceptions, a news outlet can report the news as they see it, which is not nessecarily the way the Whitehouse sees it. |

I am not a fan of this. Comes across as being very thin skinned. What I would do is remove most of the seats in the press room, leaving about 15. Then before every press conference, randomly generate the press outlets who will be granted admission. It's fair and avoids the cherry-picking. |

Does that help? When considering things written about public figures, like the president, the bar for proving things like libel is extraordinarily high. I can't see how anything CNN or whoever has written about him is remotely close to anything like illegal. It might be incorrect, but that doesn't actually matter. Reporting the news is still first amendment protected speech. Originally Posted By lorazepam: The white house is the president's house, and he can decide who is welcome or not. This has been tried in court several times over the span of decades and the courts have found consistently that if the Whitehouse is going to have press briefings it can't bar specific news outlets or specific reporters from those without good reason because of 1st and 5th amendment issues. Not liking what they report isn't good enough. Alleging that the news being reported isn't factual isn't good enough. If the administration wants to take this court they can, but they'll probably loose. |

If I should go to the WH and demand access to cover things, I'm not getting in. All these freedom of the press judges need to open up their chambers - we have a right to know! They regularly ban or gag press in and out of their courtroom. |
