So they denied my claims again. Gave me 0% on my PACT claims. Even though I’ve had surgery on my sinuses since active duty. I guess it’s time to put it in front of an attorney. They even got the diagnosis wrong on one claim. Said it was a hip strain when it’s secondary osteoarthritis in the hip due to two knee surgeries.
I’m trying Berry Law form for starters. Maybe next I’ll try REE medical, has anybody used them?

On PACT act I got 0% on secondary hip and shoulder it was denied.

They did several but what was accepted was Sinusitis. What’s interesting is I had two rhino/septoplasties and a balloonectomy, as well as perpetual use of Albuterol, which they send to me as well as constant use of Benzedrex for many years…all documented. They even took X rays of my sinuses and noted surgical changes.
I believe it’s obvious they’re not reviewing any of the notes or documentation in these cases.

They're going to rate your disability based on impairment, not the medications you take or your surgical history. Those really only help establish that there's a problem you've been addressing. 0% is better than denied. They're acknowledging that they own it.

The knee and hip issue is a separate matter. Hard to offer insight without knowing what your filing looked like but, my experience has been that there is usually something missing.

Did you tell them your current symptoms?  I just had my exam friday for sinusitus, rhinitis, dry eye and a few other things diagnosed in service.  Ive had 2 surgeries, 2 different daily pills and a prescription nasal spray which still leave me with clogged nose, clear and yellow thin discharge and thick/milky discharge 5-7 days a month, post nasal drip, tenderness/pain in my nasal sinuses, antibiotics 2-3 times a year for a few weeks.  I just told them all that and uploaded my treatment notes, CT scans, surgery documents, prescription fills for the past few years, etc. I feel like the base line raters, from what I am reading, are in a time crunch and unless its spoon fed to them, or due to timing of "get that case closed", they are denying to get these off of their queue as fast as possible requiring HLR for a proper rating.

I don’t think they reviewed the notes on any of the decisions. There were X rays, CT scans, civilian doctor’s opinions and case history.

OP, I am not going to bash the VA, I think for the most part they are stuck with a shit sandwich.  My care has been good but the whole paperwork side, filing claims, etc., is a nightmare.
I literally sent them X-rays and hospital paperwork showing where I was injured on duty and sought care at a MTF for broken bones.  They sent the material back to me with a note saying there was no record or proof of this incident

I finally went to OKDAV and they accomplished more in 3 months then I was able to in 17 years.
