I'll be as brief as possible... Dad died. No real assets but an old Harley. Granddaughter claims to have a written note that says she can have it. Nobody has seen it yet (been 2 months). The bike is being fixed to a running status by a family friend and then returned to me. There is an outstanding debt due to his funeral that I incurred. I can pay it but no other siblings help so I'm a little butt hurt over it. Can I sell this bike and recoup some of this debt without violating a potential handwritten note that nobody has seen? What happens if it pops up later as legit but I sold it to pay debt? The granddaughter has no means to fight this in any way. She literally lives in an RV at a trailer park that's being paid for by my mother. No job, no ambition etc... I am being a little spiteful over the whole situation but his kids should have domain over remaining belongings it seems...to me at least. Any advice would be awesome, thanks. |

funeral and outstanding debts go first. then remaining assets as described in the will. So yes, as executor it is customary and expected for you to liquidate estate assets to cover such expenses. None of you are expected to pay pit of pocket for that. if that can be done without selling the bike (which you apear to no), then upon her demonstration of a believable note, as executor, you should try to do. basically, she needs to pay the funeral expenses, provide the note and she can have the bike. but she won't so short answer - Sell the bike, pay the bills, let her know the estate needed to liquidate to pay the debts pwed. |

No will filed with the county clerk? Then as far as I know the estate goes in to probate with a county judge. Debts that are filed with him get paid by his assets. The bike is an asset. I don’t think it matters if she has a note that he really signed. Who is going to pay the bike repair guy? At least here the judge will assign a likely family member as the designated party to pay the bills that were filed in the court with the proceeds from the deceased’s assets. If your state runs the same way I wouldn’t sell anything until assigned by the court. Yea I know people do just that with small estates all the time with little to no repercussions. My deepest condolences. |
The only hyphenated names I like are cartridge names......30-06, 30-40, 38-55 etc.

My deepest condolences. No debt other than what I incurred from the funeral. He had no other assets. The repair is being done by a friend that feels he needs to do it for his closure. The judge isnt taking this into probate either. Really small county, just no interest since there was no property of any significance. |

No will, you executor? Asset sold to cover debts incurred by the estate, a ''note'' means nothing. Does her BF want it or does she just want to sell it for the money? Have list of all funeral and estate costs incurred by yourself and send her a copy of it. If you want the bike instead, are you the most direct legal heir? Grandkids follow the deceased children as far as the passing of goods usually if there is no wife or will. |

If she wants it, find out what it will sell for and tell her she can buy it from the estate for that price since the estate is in the negative. |
