I mean, "shall not be infringed" is as straight forward as it gets, but here we are. Agee also. But, reading any gun law doesn’t make any sense for someone that has any common sense at all. Most laws dealing with anything other than use of a firearm, and certainly almost all of them at the federal level, can and should basically be read like you're either dealing with a child trying to justify why they're allowed to do some idiotic thing that they clearly and obviously shouldn't be doing or a psychopath who probably wants to murder you trying to scam you into signing away your rights in some kind of bullshit consent decree. All it ever is with these people is either childish and moronic "I HATE THAT SO NOBODY CAN HAVE THAT" or some psychopathic compulsion to manipulate and control what other people do. With a small nod to the subset of psychopaths who use the "I'd go out and murder people if I had ____ so I'm sure everyone else would too" justification to arrive at the same shitty place. Oh, actually, I guess SBR/SBS disprove that a little. Those were basically left in because of bureaucratic inertia and spite after the handgun ban that gave them any practical utility was removed from the NFA before it was passed. So that's just an enduring FU from great grandpa's generation at this point. |

I mean, "shall not be infringed" is as straight forward as it gets, but here we are. I think getting as many SBRs SBSs and Suppressors legally out in the wild over the next 2 years at least by any means necessary makes it harder to corral them later. Making something illegal after the fact runs into a lot more legal hurdles. As I understand it "reconciliation" where the tax can be reinstated doesn't happen often and effectively means all three entities of House Senate and President are controlled by the same party for a simple majority of over 50 votes to make it pass. Prosecution would likely depend on proving when something was made or otherwise acquired. 4473 might prove that or might not. A lot will depend on whatever rules are put in place by the ATF to mitigate future legal threats. I've said this elsewhere and I want to keep pounding. One thing we need to push from all Republican Presidential Candidates is if elected they pardon on day one all SBR/SBS/Suppressor Federal convictions. I know we have some bad actors that these are add on charges, but I want whatever DOJ is in charge to realize that these are futile to waste time on. ATF and DOJ I no longer trust to not abuse these statutes and to me a blanket pardon is the way to prevent this. |

If they’re not transferred via Form 4. The NICS check is done when you pick it up since they’re treated as regular firearms. If it was done on a Form 4, there is no NICS check required when you pick it up and complete the 4473 since the NICS check was done during the NFA process. Attached File |

Form 1 / form 4 is a check on a number of things, including that you follow fatf rules correctly, as well as then sending to the fbi for a background check, which I believe includes a nics check but also runs your fingerprints, etc. more in depth than a standard nics check |

If it’s the same background check, why does it take the ATF and NFA process so long when at a dealer it’s 10-15 min? |

You are correct. The NFA was passed a bit over 16 months after Prohibition was repealed and any gangsters would've long since had their black market dried up by new legal production. The NFA exists purely because Prohibition failed, they had a bunch of BIR agents suddenly had nothing to do, and what were they going to do...just not crush the people's rights and fire them all? lol |
