Exceptions are made for particularly heinous crimes. Insurrection, it's what they're calling this, is likely one for which bond might be excepted. Then there's Article I, Section 9 of the U.S. Constitution which provides that "[t]he Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it." |
