The Borough of Englishtown is considering a resolution which would refund a significant portion of applicants' permit to carry fees. Town Resolves That Excessive Permitting Fees are Unconstitutional On Wednesday evening, the Borough of Englishtown, New Jersey adopted a resolution that refunds much of the state's $200 permit to carry fees. Passage signifies the unconstitutionality of the fee, and rebates the municipality's portion back to applicants. This step is a giant leap towards repatriating citizens with a more whole version of the Second Amendment. Having to only endure a $50.00 fee over a $200.00 fee is much more reasonable. While this is just one town in New Jersey, proponents of the measure should be hopeful that this trend will take off like wildfire across the Garden State. "Governor Phil Murphy and the equally misguided legislature in the Garden State may have forced these fees upon permit to carry applicants, but Trenton can't tell municipalities what they can and cannot do with the funds they collect. In refunding these monies back to the people, it's a clear message about the unconstitutional nature of the law A law that Murphy enacted in December of 2022 because Bruen upended the law. The Englishtown mayor had the fortitude to put the unconstitutionality of these fees on the record, calling Trenton out on their hatred towards gun owners and the Second Amendment." This N.J. town just became the first to eliminate its gun permit fees The resolution was supported by the New Jersey Firearm Owners Syndicate (NJFOS), a nonprofit founded in 2024 and led by longtime Second Amendment advocates, including Director Joe LoPorto. "Our end goal here was obviously to help get this resolution passed in Englishtown, but we want to introduce this in as many jurisdictions and municipalities around the state as we can," LoPorto told NJ.com. "This is hopefully one of many future (towns) that will embrace this idea." During the public hearing, LoPorto argued that no core constitutional right such as free speech or religious freedom should be hidden behind a financial barrier, warning that the permit fee policy disproportionately harms Black, Indigenous, and People of Color (BIPOC) communities. "There are towns in Atlantic, Gloucester, Sussex, and Hunterdon counties that are, right now, considering this resolution," LoPorto said.
