I may be wrong, but I don’t believe they have a case.  Their claim is that TN is in violation of the Civil Rights Act of 1964. The only way for that to happen is for drivers licenses to be federally funded.  The Real ID Act may play some roll in this, but I doubt it.
Regardless, this crap needs to be fixed. Congress needs to make English the official language and amend that Act.
