| Not sure how this works. If someone in WI has had criminal charges filed against them, but they have not yet been arrested (their location is unknown) will the charges appear on ccaps when filed, or not until an arrest is made and the person is in custody, and appears in court? |
| I don't believe anything appears in CCAP until a case is assigned. If a warrant is issued but not served, there is no plea to enter a case with. There would really be no records to enter in the system till an arrest is made and an initial appearance is made. Again, just speculating here. |

Ccaps is actually a record of what happens in a court of law. But when it comes to how govt. functions, nothing surprises me. |

“Filed” charges will appear on CCAP. Typically if a complaint is filed a summons with a court date will be served to the defendant if they are not in custody. There can also be a “complaint and warrant” filed which will reflect on CCAP. Someone can be arrested and sitting in jail and not be on CCAP. Every jurisdiction is slightly different but for most a formal criminal complaint will be filed in 48-72hrs following an arrest. ETA: After reading the OP a second time. We can issue a fugitive warrant, ie an arrest warrant and hold off on filing a formal criminal complaint until the defendant is in custody. We sometimes do this as to not tip off the defendant that they are wanted and thus make them go into hiding. |
