So with the ruling that dropped what specific laws are holing us up on sbr,sbs,and suppressors? What steps do we need to take to get this fixed? It's kind of crazy how we went from one of the best gun rights states, to just another oppressed state overnight. |

You can do them on a 4473 if they come from Silencer Shop or PSA, or if you are a member of GOA effective 8/1326. The problem is something in our state laws are keeping us from enjoying to end of the restrictions. |

| Alaska is one of the states that was a plaintiff in the lawsuit. so theoretically we should be able to transfer on just a 4473 best to ask your dealer if they do this or are planning to do this in the future |

So we may be fine at the federal level, but still can be prosecuted at the state level. |

Originally Posted By mdw: Alaska is one of the states that was a plaintiff in the lawsuit. so theoretically we should be able to transfer on just a 4473 best to ask your dealer if they do this or are planning to do this in the future My understanding is Alaska was part of the suit in order to stop having to do forms for the governments gear, not for alaskan citizens...I am not sure exactly which laws we have on the state level that is stopping us, my guess is the wording that in order to be legal here for whatever gear it is must be registered and approved per federal laws(NFA/GCA/ETC), since you wouldn't be doing the form 1/4/ whatever is correct, then that firearm/silencer would not be legal here...Our state would have to change its laws I think.. |

Alaska Statute 11.61.200(c) says: “It is an affirmative defense to a prosecution under (a)(3) of this section that the manufacture, possession, transportation, sale, or transfer of the prohibited weapon was in accordance with registration under 26 U.S.C. 5801–5872 (National Firearms Act).” AS 11.61.200(h)(1) defines “prohibited weapon” to include: •A device designed to muffle the report of a firearm (suppressor) •A machine gun •A rifle with a barrel under 16” •A shotgun with a barrel under 18” •A rifle/shotgun modified to have an overall length under 26” Alaska law does NOT say “you must possess an ATF Form 1 or Form 4.” It says the NFA weapon must be “in accordance with registration under 26 U.S.C. 5801–5872. And then there’s also this: The Alaska Firearms Freedom Act is AS 44.99.500. (a) “A personal firearm, a firearm accessory, or ammunition that is manufactured commercially or privately in this state and that remains in the state is not subject to federal law or federal regulation, including registration…” (b) “This section applies to a firearm, a firearm accessory, or ammunition that is manufactured in this state from basic materials… The Alaska Firearms Freedom Act is broad enough on its face to make an argument for an Alaska-manufactured, Alaska-retained SBR, SBS, suppressor, or even machine gun (Although I’m not sure how to safely go about getting a state legal opinion on this) |
