On the 10th I was rear-ended while sitting in a parking lot waiting for my wife to finish shopping.  Yep, in park, in the parking lot taking only one space.  She pushed me a good 4'-6' from where I was parked.


Thankfully there was a city cop who happened to be in the parking lot and witnessed the whole thing and did a report.  He gave me a FR-10 with the other vehicle/driver info and mine as well.  Certain blocks were redacted though.

I've only been in SC for 5 years now and not all familiar with the DMV rules here.  The FR-10 says it has to be turned into the DMV within 15 days.  The cop said I need to inform my insurance company (mom's actually since it was her car I was using) within 14 days.

Do I have to submit the FR-10 to the DMV or is that the driver of the other vehicle, or is it already done via the police report and he just gave me my copy?

I spent most of my life in Virginia where I only had to deal with insurance companies, never the DMV for accidents.

My mom's insurance company called me for my statement and they submit the FR-10.  So I sent it to them.

Sadly, my mom has to deal with Progressive to try to get her car fixed.

The FR-10 is just a self reporting wreck report. Since most traffic laws don’t apply on private property, there’s not usually a lot for law enforcement to investigate. The insurance company is perfectly capable of determining fault, on their own. You can think of the FR-10 as an official way to exchange insurance information with the other driver. Most private property crashes rate an FR-10. It’s also used if a person tries to report a crash long after the fact. Since any investigation would be compromised, the driver gets an FR-10 and they can take it up with the insurance company. If you ever get issued an FR-10 be sure that your insurance company follows up with providing proof of insurance to the DMV. Otherwise, you may end up under suspension.

If you gave the FR10 to your agent you are done with that portion.

Dealing with Progressive will be a nightmare.  It took 3 months just to get an adjuster to look at my wife's car when we got hit last year.  They drug their feet and argued forever.  I ended up reporting them to the insurance commission to get them to act.  You should probably start there.

KEEP RECORDS OF EVERYTHING!!!  Pictures, copies of every email, voice record every phone conversation.  Video when the adjuster is there to see the car, everything.  Progressive is the scum of the earth and will argue everything.

My mom's car was totaled by Progressive.  The shop got to ~$6500 in repairs and stopped.  So my mom picked up her license plate and anything personal from the car so it could be towed to the adjuster where they will give her a price for her car.  We haven't heard anything back yet on that part, though we are expecting them to offer her something like $2000 for the car.  I told her to look up comparable vehicles for sale right now and base her acceptable value on that.  I know my mom, she won't haggle much.  

We have a local shop that said it would be under $2000 to fix her car.  So now her plan is to get the car via salvage and have it repaired.  It would appear that means Progressive will only give her 75% of the agreed on value and the car.  Then she can use that to have the car repaired.  We shall see!

On the bright side, she is in a rental for now so she isn't without wheels.

My mom got her car back from the shop and it looks amazingly good for what happened to it.

This seems obvious to me, but I figured I'd ask here.  I told my mom to take her paperwork from Progressive and her old registration/plates into the DMV to ensure it is registered properly since it should be a "salvaged title".

The question is; is this required?  Seems to me it is, but I've never dealt with a salvage like this before.  In my mind, ownership changed when she totaled it and gave it to Progressive.  So when Progressive sold it back to her that would require a new registration/title.  Am I right?  She's going to head to the DMV later today to ensure everything is right with it so she doesn't get pulled over.

Did your mom officially sign the title over to them when she sold it?

Did she get a bill of sale when she bought it back?

Hope it gets all straightened out.

I've got to find out from her on that.  I've not seen any of the paperwork (she is very independent and generally likes to handle everything herself) but she did call the DMV and they said she doesn't have to change her registration but will have to have the title redone to be a salvage title.  Hopefully we don't get pulled over driving the car and find out the hard way it wasn't right.  I'll get on her to ensure it is done and right either way.

Here are the after photos of the car from the local repair shop.  They charged ~$2100 to repair the back, tack up the falling headliner and repaint the top of the car that was turning white.  What amazes me is they didn't replace the trunk lid, they fixed it and repainted as needed.  The Summerville Ford sticker was the giveaway for me.  My mom thought they replaced the lid since it was so close to right.







What looks like brush strokes are visible in the paint when you get up close.  The trunk lid also doesn't perfectly align on the driver's side.  Over all though, it really is impressive the repair work for the price.  The collision center was apparently going to replace everything in their quote.  I'm guessing only the bumper cover, bumper trim piece, driver's taillight, and trunk latch parts were the only things replaced.

It was awesome that we got the car back and it was in such great condition.  Especially after being totaled.  

Then on 9/11 we got T-boned because my daughter didn't look right and pulled out onto a major road.  I was in the passenger seat.





Everyone walked away from the wreck.  Even me.  I actually crawled out of the rear driver's side door when I realized my door had exploded.  I do have some broken ribs, but other than that it was all bruises.  My daughter was fine though really shook up.  The drive of the car who hit us is fine, though he has a lawyer and is suing.  My mom got a new SUV and my daughter paid my mom for the car since she was supposed to buy it anyway, just not yet.

Oh, I got another FR-10! (Ok, actually my daughter did,). This time I knew what to do with it.
